REPUBLIC OF KENYA

CHILDREN MAINTENANCE AGREEMENT

THIS AGREEMENT is made on the .day of Two Thousand and


Thirteen between ALEXANDER OMONDI (ID NO. 20593253) of P.O Box 5554-00200
Nairobi of one part, (hereinafter the Father) which expression shall where the context so admit
include his personal representatives, heirs, assigns and successors and LILIAN AWUOR
BANGO (ID NO…………………………) of P.O Box ………………….., Nairobi (hereinafter
the Mother) which expression shall where the context so admits include her personal
representatives, successors, heirs and assigns of the other part.

WHEREAS
1 The Father and Mother are separated and living apart and blessed with three issues and
the Mother having legal custody of the minors; the parties are desirous of entering into a
maintenance agreement for the issues;

2 The Father and Mother wish to have to this agreement adopted by the court as the final
agreement between them as regards the maintenance of the minor children; and

3 The parties have agreed that they no longer wish to share any other relationship with each
other apart from their mutual parental responsibilities over the three minor children.

IT IS HEREBY AGREED as follows:

1. That the issues to be maintained by both the father and the mother are:
a. CHLOE ADHIAMBO 9 YEARS
b. TYRA ACHIENG 7 YEARS
c. SHANTEL AKINYI 3 YEARS

2. The Father will exclusively and/or individually meet the following expenses for the
three minor children:
a. The school fees until they complete their secondary education.
b. The uniforms and stationery until the end of their secondary education
c. All expenses for the minors when they visit the Father in his premises.
3. The Mother will exclusively and/or individually meet the following expenses for the
three minor children:
a. The rent for the premises she resides in together with the minors.
b. Utility bills for the house.
c. Food and grocery expenses.
d. Transport expenses to school.
e. Entertainment expenses.
f. Clothing expenses
4. Both the Father and the Mother will share the following expenses equally:
a. The medical expenses for the minors as and when they fall ill.
b. The university education for the children.
5. Both parents will make their best effort to create and maintain equitable environment
for the children at their respective homes, including but not limited to the children
belongings, clothing, toys, and other play equipment.

6. Term
The term of this agreement shall be in force until the last minor child has completed
her secondary education. The terms of this agreement will be reviewed for the
individual children when they complete their secondary education.

7. The Father will have access to the children as and when he wishes to provided that he
gives the Mother One(1) day’s notice of his desire and/or intention to have access to
them.
8. Arbitration
In case of any controversy or claim arising out of or relating to this Agreement, or the
breach hereof, both parents agree that they shall submit the dispute to binding
mediation by a mutually acceptable mediator. The cost of the session or sessions with
the mediator shall be shared equally.

9. Governing Law
This agreement shall be governed by Kenyan Law .
10. If any clause of this agreement is determined to be unenforceable, those clauses shall
be severable, while the other provisions of this agreement shall remain in effect.
11. This agreement contains the full and complete understanding between the parties and
supersedes, replaces and cancels all prior arrangements or understandings
