TRANSFER OF OWNERSHIP
PURSUANT
DAR A.O. NO. 08, SERIES OF 1995
ORDER
For consideration before this Office is a Land Transfer Action, pursuant to DAR
Administrative Order No. 8, Series of 1995, involving a landholding embraced by Transfer
Certificate of Title (TCT) No. C-1072 (s), bearing Certificate of Land Ownership Award No.
00450580, particularly described as Lot No. 2, Psd-02-060556-(AR) with an area of Nine
Thousand Two Hundred Nine (9,209) square meters, more or less, and located at Calog Sur,
Abulug, Cagayan.
STATEMENT OF FACTS
Petitioner-transferor Anthoney Jinn Farin was awarded the subject landholding herein by
virtue of the Comprehensive Agrarian Reform Program under Republic Act No. 6657, as
amended and duly registered the same on March 28, 1996 with the Registry of Deeds of Sanchez
Mira, Cagayan.
Almost Twenty (20) years later, or on June 14, 2016, the original farmer-beneficiary sold
the subject landholding to Mary Jane C. Arellano, because the transferor can neither nor develop
the land thus, executed a Deed of Absolute Sale of a Parcel of Land in favor of the herein
transferee who is now the actual occupant/ tiller of the said lot with the help of her family since
the sale was executed.
Then Anthoney Jinn Farin wrote to the Municipal Agrarian Reform Program Officer
(MARPO) of Abulug, Cagayan, requesting that the subject lot be transferred. The MARPO, in
his report, gave a favorable recommendation, to which the Provincial Agrarian Reform Program
Officer II (PARPO II) of Cagayan adopted.
ISSUE
For resolution before this Office is whether the application for transfer of the subject
agricultural land should be granted.
DECISION
After a thorough examination of the facts and the records submitted, this Office
resolves to adopt the recommendation of the PARPO II and grant the petition of petitioner-
transferor Anthoney Jinn Farin.
DAR Administrative Order No. 8, Series of 1995 allows the transfer of awarded lands
under Presidential Decree No. 27, as amended by E.O. No. 228 and Republic Act No. 6657,
provided that the following shall be observed:
(2) That the buyer will not exceed the aggregate landowner ceiling provided by
law; and
(3) That the ownership ceiling of five (5) hectares shall be imposed.
Here, the Provincial Assessor's Office of the Province of Cagayan and Municipal
Assessor's Office of the Municipality of Abulug certified that the buyer-transferee had no
declared real properties.
As for the prohibition on transferring lands covered by the agrarian reform program
within the prohibitive period of ten (10) years from its grant, the same was fully complied with
as more than Twenty (20) years has elapsed since the awarding of the subject parcel of land.
Finally, after careful consideration of the documents submitted, this Office finds that the
documentary requirements imposed by DAR Administrative Order No. 8, Series of 1995 was
substantially complied with by the parties herein.
1. GRANTING the written request for the transfer of the ownership of the subject land
covered by TCT No. No. C-1072(s), bearing CLOA No. 00450580 to Mary Jane C.
Arellano;
3. DIRECTING the Registry of Deeds of Sanchez Mira, Cagayan to annotate this Order
in TCT No. C-1072(s);
SO ORDERED.
This Order shall become final and executory if no appeal or motion for reconsideration is
filed within fifteen (15) days from receipt hereof by the parties.
