Dear Ma’am:

We write on behalf of our client, PINKY U. APOSTOL, and this pertains to her
request for exemption from the election ban.

Our client is presently hired at Pasay City West High School, Pasay City as
Teacher II. She was originally from Bohol and has left home for more than eleven (11)
years. Unfortunately, in December 2020, her mother was diagnosed with Chronic Kidney
Disease Stage IV which required her to undergo dialysis sessions two times a week.
Since she was the only single daughter, she assumed responsibility to her mother.

Luckily, there was an item vacant (natural vacancy) in Mahayag National High
School, Mahayag San Miguel Bohol on January 1, 2022. She took this as an opportunity
to live close to her mother in Bohol. She immediately applied and ranked number one.
Accordingly, she is very much qualified to assume the position vacated.

Her transfer is an urgent need to the Mahayag National High School due to the
hole left by the vacant position on January 1, 2022. Now, while she possessed the much-
needed qualifications and had undergone almost all the necessary processes to fill in the
vacant position, she was barred and forced to discontinue due to DepEd Memorandum
No. 005, s. 2022. Accordingly, this memorandum barred her to fill in the position during
the election period. The school is left with no choice but to assign its teachers with more
loads.

In this connection, our Firm, on behalf of our client, is fervently praying that you will
exempt her from the election ban. This transfer entails no promotion. Per Document 22-
0010 by the COMELEC, the transfer shall be allowed as long as it is signed and issued
by Sec. Briones, hence, this request.
