SUBJECT- REPLY NOTICE AGAINST YOUR NOTICE DATED 05/06/22.

Sir,

Under the pursuant of my clientShriAmitava De owner of M/s. Columbia Medical Systems, Resident of
78/A, Sukanta Park Kolkata, West Bengal -700101, Registered Office at B.K Road, Boinchi, Dist- Hoogly,
Kolkata, West Bengal-712134, Corporate Office- Primarc Tower , Flat no- 702, 7 th Floor, DN-36, DN Road,
Sector-v, Salt Lake, Kolkata, West Bengal -700091.

That my client is a owner of Columbia Medical systems company which deals with medical equipments.

That ManishaDhamal, W/o Dr. MahendraDhamal being the proprietor of the organization namely
MANASHI MEMORIAL HOSPITAL lying and situated at 32/1, behind Khandala S.T Stand Paragon,
Khandala, Dist- Satara, Maharastra, invited various organizations to submit their respective quotations in
respect of supplying medical Equipments namely 1 Mamography Machine, 1 TMT Machine, 1 USG/Color
Doppler, 1 BMD Machine and accordingly my client’s company submitted their bid which was ultimately
accepted. Thereafter the bank issued Rs 48,37,600/- in favour of Columbia Medical Systems on 2/2/2019
to supply the equipments to Manashi Hospital.
After receiving the said amount from the bank, Dr. MahendraDamal requested my client to transfer Rs.
24,22,387/- through RTGS and as per his demands, my client paid Rs. 19,22,387 on 6/2/19 and a further
amount of Rs 5,00,000/- on 20/2/19 to Dr. Dhamal. Subsequently my client paid Rs. 15,77,613/- to
Elesonic Medical Systems for the supply of Cathlab as per the request of Dr. Dhamal and Mrs. Dhamal
but Elesonic Medical System paid back Rs. 6,00,000/- Lakhs to Columbia Medical system for purchasing
USG Machine from KPI Health Care Pvt. Ltd in order to supply the same to Manashi Hospital. Therefore
my client paid Rs. 5,75,000/- to KPI Health Care Pvt. Ltd as full payment for supply of oneUSG Machine
to Manashi Hospital but unfortunately the machine could not be supplied till date as the
ManashiHospital could not arrange PCPNDT which is mandatory for installation of USG Machine.

Thereafter on 15/10/20 Mrs. Dhamal suddenly cancelled the order of USG machine through E-MAIL
without any prior intimation and demanded from my client to pay back Rs.7,50,000/-( seven Lakhs fifty
thousand) which was given for procuring the USG machine, and also asked for a further amount of Rs.
10,00,000/- (ten Lakhs) as an excess amount which was to be paid to Dr. Dhamal and Mrs. Dhamal.

Later on my client issued two cheques of Rs. 6,18,000/- and Rs. 3,82,000/- to Manashi Hospital with a
condition that an agreement would be signed and the cheques will be presented to the said bank as per
the agreement. Unfortunately my client somehow managed to come through the knowledge of the
agreement where you have mentioned wrong terms and conditions which my client revoked to signed
as the agreement wasn’t void and they made the agreement according to their terms and conditions
which my client previously intimated Mrs. Dhamal to mention such clause, and without my client's
knowledge Mr and Mrs. Dhamal deposited the cheque to the bank to harass my client and file a suit U/S
138 to 142 of the Negotiable Instruments Act against the cheque which my client had given them even
my client previously mentioned them not to deposit the following cheques whereas my client never
denied to pay the money to Mr. and Mrs. Dhamal but without my client’s knowledge they deposited the
cheques just to file a false case against my client and to extort money from my client illegally.
On the basis of above mentioned circumstances, I would like to inform you that if you constantly
continue to harass my client then my client will be bound to take strict and stringent action against you.
