Pretrial Diversion Agreement
¶1 The State of North Dakota, represented by Allen Koppy, and the Defendant, Hashi Anod
Shire, by and through his attorney, Thomas A. Dickson, enter into the following stipulation:
¶2 WHEREAS, the parties believe it is in the best interests of the State of North Dakota and the
Defendant that a Rule 32.2, N.D.R.Cr.P., Pretrial Diversion Agreement be entered based upon its
statutory provisions.
¶3 WHEREAS, after the State of North Dakota having evaluated the potential concerns of this
case, it is agreed between the parties that the prosecution of this matter should be suspended for a
period of six (6) months, after which it will be dismissed under Rule 32.2(f), N.D.R.Cr.P., on
conditions that the defendant not commit a felony, misdemeanor, or infraction during the period.
¶4 That, I, Hashi Anod Shire, concede there is a substantial likelihood that a conviction could
be obtained and that the benefits to society from rehabilitation outweigh any harm to society from
¶5 The Defendant shall follow all conditions set forth in this Agreement.
¶6 The Defendant hereby voluntarily and knowingly waives any and all rights to a speedy trial
in this matter.

¶1 The above matter came before the Court pursuant to a Rule 32.2 N.D.R.Cr.P. Pretrial
Diversion Agreement. The Court, having considered such Agreement, and finding that the
¶2 NOW HEREBY ORDERS that the above entitled matter is suspended for a period of
six (6) months, after which it will be dismissed under Rule 32.2(f), N.D.R.Cr.P., on the condition
that the Defendant not commit a felony, misdemeanor, or infraction during that time period and
that the Defendant shall follow all conditions as set forth in the Agreement entered in this case.
