Article 19. Every person must, in the exercise of his rights and in
the performance of his duties, act with justice, give everyone his due,
and observe honesty and good faith.

• Article 431 of the Civil Code provides that "the owner of a thing
cannot make use thereof in such a manner as to injure the
rights of a third person." SIC UTERE TUO UT ALIENUM NON
LAEDAS.
Examples:
If the act causing damage was done willfully, check if the act
done constitutes a felony under the Revised Penal Code or as an
offense under any other special penal law.

If the act causing damage was done negligently but does not
constitute a felony under the Revised Penal Code, apply the law on
torts under the Civil Code. This law on torts of quasi-delicts is Article
2176 which provides:
Article 21. Any person who willfully causes loss or injury to another
in manner that is contrary to morals, good customs or public policy
shall compensate the latter for the damage.
