(Retired), Respondents, ATED WRIT OF EXECUTION Greetings: WHEREAS, on 31 May 2012, a Decision in the above-captioned case was rendered by then Labor Arbiter Quintin B. Cueto III declaring the dismissal of complainants as illegal and directed respondents to reinstate complainants for their former position without loss of seniority and rank and to pay the 181 complainants backwages, 13” month Pay and 10% attorney's fees, all in the total amount of P17,560,620.00: WHEREAS, on 18 June 2012, respondents interposed an appeal and posted an appeal bond in the amount of P10,000.00. WHEREAS, on 27 July 2012, the Honorable Commission (4° Division) Promulgated their Decision, dismissing the appeal for non-perfection; WHEREAS, on 22 August 2012, respondents filed their Omnibus Motion to allow them to post supersedeas bond equivalent to the monetary awards and to reconsider the Commission's Decision promulgated on July 27, 2012; but on September 24, 2012, the ——_ J CERTIFIED TRUE WUP'Y re Mende ried I | Administrative Officer V | | | LUPOATED WRIT OF EXECUTION PHIL. AVIATION SECURITY SERVICES CORP. 205 Commission (4" Division) promulgated their Resolution, the dispositive portion of which reads as follows, to wit: “WHEREFORE, in accordance to Section 15, Rule VII of the 2011 NLRC Rules of Procedure, let this Motion for Reconsideration be DISMISSED for lack of merit. No second motion of the same nature and substance shall be entertained. SO ORDERED.” WHEREAS, on 22 October 2012, respondents filed their Extremely Urgent Omnibus Motion with Leave of Court Ad Cauteliam; WHEREAS, on 13 November 2012, the Honorable Commission (4" Division) Promulgated a Resolution, the dispositive portion of which reads: “WHEREFORE, let this second Omnibus Motion filed by the respondents-appellants be DENIED for being contemptuous and for utter lack of merit. Should another motion of the same nature be filed by respondents-appellants, the latter shall suffer the penalty of contempt as provided in our Rules. SO ORDERED.” WHEREAS, the foregoing Resolution became final and executory on January 16, 2013 per Entry of Judgment issued by the same Commission; WHEREAS, the partial judgment award as of date of Decision on 31 May 2012 was computed in the total amount of P17,560,620.00; WHEREAS, under the 2011 NLRC Rules of Procedure, a writ of execution was issued on 25 February 2013 to effect reinstatement and collect the amount of P17,560,620.00. WHEREAS, on 14 January 2013, respondents filed a Petition for Certiorari at the Court of Appeals. WHEREAS, on 18 April 2013, Sheriff Nicdao submitted his Report stating that he conducted a public auction sale on 17 April 2013 and the winning bidder was Gloria M. Pajares, the authorized representative of the complainants with a bid price of P400,000.00 which shall be deducted to the total monetary award; thereafter, a Certificate of Sale was Issued on the same date; [UPDATED WRIT OF EXECUTION PHIL. Page 3 of § WHEREAS, on 2 May 2013, Sheriff Nicdao submitted his Progress Report stating that he deposited in the NLRC Cashier the garnished amount of P111,457.66 (P56,578.97 + P46,796.81 + P8,081.88) thus, on 8 May 2013, an Order was issued directing the NLRC Cashier to release the said amount to the complainants; WHEREAS, on 16 May 2013, complainants claimed from the NLRC Cashier the amount of P109,980.37, the net amount after deducting the execution fee of P1,000.00 and deposit fee of P577.29; WHEREAS, on 27 May 2013, complainants filed an “Urgent Ex-Parte Motion for Correction of Final Decision dated 31 May 2012 and Writ of Execution dated 25 February 2013; WHEREAS, on 5 June 2013, an Order was issued for the correction of the name of private respondent from Francisco A. Villa, Jr. to Francisco A. Vila, Jr.; WHEREAS, on 10 June 2013, complainants filed a “Motion for Issuance of Alias Writ of Execution”; WHEREAS, a re-computation of the judgment award was submitted by the NLRC Examination & Computation Unit on 20 June 2013 showing accrued wages from June 01, 2012 to June 18, 2013 summarized below: ‘Accrued wages = P186,551.70 x 181 P33,765,857.7 Backwages per Decision a) Basic = P75,600 x 181 P13,683,600.00 b) 13 mo. Pay = P12,600 x 181 = — 2,280,600.00 TOTAL = P1Z,560,620.00 TOTAL = — P49,730,057.70 Attorney's fees = 10% x P49,730,057.70 = 4.973,057.77 GRAND TOTAL = P54,703,063.47 WHEREAS, on 26 June 2013, an Order was issued granting the issuance of Alias Writ of Execution reflecting the correct name of the respondent to BGen. Francisco A. Vila, Jr. (Retired); WHEREAS, on 1 July 2013, Sheriff Nicdao submitted his Sheriff's Return with the copy of the original writ partially satisfied; ‘WHEREAS, the remaining balance to be collected from respondents is in the amount of P54,193,083,10 (P54,703,063.47 minus P400,000.00 minus P109,980.37); || LUPOATED WRIT OF EXECUTION PHIL. AVIATION SECURITY SERVICES CORP, Page 4 of 5 WHEREAS, on 19 July 2013, a conference was called for filing of Comment on the re-computation but respondents failed to appear; on even date, complainants also filed a “Motion to Substitute Assigned Sheriff”; WHEREAS, on 26 July 2013, an Order was issued referring complainants’ motion for substitution of Sheriff wit the Office of the Executive Labor Arbiter; WHEREAS, on 30 July 2013, a new Sheriff was assigned to enforce the judgment in the person of Sheriff Manolito G. Manuel; WHEREAS, on 6 August 2013 a Temporary Restraining Order (TRO) was issued by the Supreme Court. WHEREAS, on 21 June 2019, the case was re-raffled to the undersigned due to the retirement of then Labor Arbiter Quintin B. Cueto III; WHEREAS, on 11 July 2019, complainants thru their counsel filed an Omnibus Ex-Parte Motion to Proceed with the Implementation of the Writ of Execution and With Motion for Recomputation; WHEREAS, on 15 August 2019, a pre-execution was held but only the complainants and their counsel appeared. The Pending motion for issuance for issuance Of alias writ of execution based on the recomputed award as per decision of the Supreme Court dated August 6, 2013 is granted. WHEREAS, respondents up to this time failed to comply with the reinstatement aspect of the Decision. Thus, complainants are entitled to accrued wages until respondents compliance. NOW THEREFORE, you are hereby commanded to collect, in accordance with Section 9, Rule XI of the 2011 NLRC Rules of Procedure, as amended, the total amount of P275,834,886.50 (as shown in the updated computation of complainants’ monetary award of P276,344,866.82 less the garnished amount of P509,980.37) from respondents Phil. Aviation Security Services Corp. (PASSCOR) at PASSCOR Building, Parking “C", NAIA Complex, Paranaque City or anywhere in the Philippines where he/she it may be located, representing complainant's award pursuant to the Decision dated 27 July 2012. Further collect from the respondent the execution fee in the amount of P2,757,848.87 and deposit fee in the amount of P1,379,194.43 pursuant to the Manual on Execution.
