Understanding Due Process

You create a scenario or story, if you want, where due process is observed. You identify the
salient points where there is the observance of due process. In another paragraph, you write your
reflection what could happen to us, each one of us, if there is no guaranteed observation of the due
process in our society?

Answer:
Laws ensuring an accused person a fair and public trial before a competent tribunal, the
right to be present at the trial, and the right to be heard in his or her own defense are included
among the provisions providing due process. The right to a fair trial and an effective remedy are
both covered by due process. The right to be treated fairly, efficiently, and effectively by the
administration of justice is defined as the right to be treated fairly, efficiently, and effectively by the
administration of justice. In order to ensure fundamental fairness and justice, the rights to due
process limit laws and legal actions.
Let’s have a scenario. There is a man who works as a college professor. He is kind and
responsible with regards to his profession. He is very industrious and diligent to his students. Also,
he treats his students fairly. Now, there is a student who is very lazy and once a week only going to
school. He barely passes activities and does not participate in class discussions. The professor then
gave a failing grade to him. The student is now angry because of the grade the professor gave him.
The student is known for as a bad boy who is always included in fights outside school. One day
while he was walking home, the student, along with his friends, beats the professor and dumped
him into the river. The professor survived from the incident but the professor was traumatized of
what his student done to him. The school investigates about the incident and ensures that someone
must be penalized by law, although the one who is liable of the crime is a student.
In this situation, we can say that due process is observed. An investigation about the
situation happened after the incident to know if there are circumstances that both sides did to do
the certain incident. There is the process that involves the two parties and states information they
know about themselves. From there, the school and authorities will determine the motive why the
incident happened. There is a fair and public trial between the accused and the one who filed the
case. Justice will be served fairly and effectively on this situation if they continue to investigate and
apply legal penalization actions in this case.
