JOB ORDER AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement made and entered into this 1st day of January 2023, by and between the
Philippine Ports Authority – Talibon Port Services, a special cargo handling unit with office address at
Barangay Poblacion, Port Area, Talibon Bohol represented by MARLOU T. BACHOCO, Manager, herein
referred to as the First Party;

-and-

ALAW, MARK ANTHONY A., of legal age, Filipino and with residence address at ___________________
____________ herein referred to as the Second Party;

WITNESSETH, THAT:

WHEREAS, to ensure the continuous provision of cargo handling services at the Port of Ubay,
Bohol and in the exercise of the inherent functions of the Authority to directly provide and operate cargo
handling and other related services pursuant to Presidential Decree No. 857, PPA-Talibon Port Services
(PPA-TPS) is hereby created;

WHEREAS, there is a need for the services of a Job Order who shall undertake to perform
services which are related to such cargo handling operation.

WHEREAS, the First Party in the process of organizing its dock labor force and the Second Party
has signified his/her intention and willingness to provide the services needed by the PPA-TPS;

NOW, THEREFORE, for and in consideration of the foregoing premises and the mutual
covenants, stipulation and agreements, the First Party and the Second Party have agreed, as they do
hereby agree, and contract as follows:

Section 1. The Second Party is hereby engaged as a Clerk for the period from January 1, 2023 to
December 31, 2023, unless this Agreement is sooner revoked or cancelled, with the compensation
of Three Hundred Eighty Seven Pesos (Php 387.00) per day, Philippine Currency.

Section 2. This Agreement is covered by the provisions of the Commission on Audit and
Department of Budget and Management Joint Circular No. 2, series of 2020 dated October 20, 2020.

Section 3. This Agreement shall automatically cease upon its expiration as provided in Section 1.
However, the First Party may terminate the services of the Second Party prior to the expiration date
for the following reasons:

a) Violation of the terms and conditions of this Agreement;


b) Lack of funds;
c) Conduct prejudicial to the interest of PPA;
d) Other analogous circumstances.

Section 4. The Second Party hereby warrants that:

a) He/She is not related within the third degree by consanguinity or affinity to the officials
and members of the PPA-TPS; and
b) That he/she has not been previously dismissed from government service by reason of
an administrative offense.

Section 5. The Second Party is expected to fulfill the functions of his/her position as Clerk as
detailed in the job description, hereto attached as Annex “A”.
Section 6. The Second Party shall be responsible for claims that may arise under ECC, SSS,
PhilHealth, HDMF and other related laws and social legislation rules and regulations.

Section 7. The services rendered under this Job Order Agreement shall neither be considered nor
credited as government service and there is no employer-employee relationship between the First
Party and Second Party.

Annex A

JOB DESCRIPTION

Job Title: Clerk

Duties and Responsibilities:

1. Receives the daily collections form the collectors.

2. Prepares Daily Summary of Collections.

3. Disburses the dockhands’ shares for cargo handling services rendered.

4. Prepares the deposit slips, remittance advices and deposits the collections in the
bank.

5. Prepares the monthly manning schedule of semi-dock workers.

6. Prepares BIR Sales Report.

7. Prepares the monthly Accountability Report of Accountable Forms.

8. Prepares the vouchers for the payment/settlement of monthly bills.

9. Maintains records of damaged claims.

10. Performs other tasks that may be assigned from time to time.
