I. ) REPORT

An interview was requested and accommodated by the Office of the Provincial


Prosecutor represented by Atty. Jon Jon Amcay. The basic procedures prosecution were
explained as well as the participation of the office in inquest proceedings. This includes
the divergence of the approach in relation to imposable penalty. In accordance with our
current rules and procedure, offenses punishable by penalties of 4 years, 2 months and 1
day or higher undergo preliminary investigation, Offenses with lower imposable penalties
then undergo summary proceedings. During preliminary investigation, a waiver may also
be requested from the suspect in order to provide more time for the investigation.

Along this vein it was explain that in cases of children in conflict with the law they are
referred to the DSWD and in some cases to their parents. If the respondent is mentally ill,
such person is referred to a mental institution.

If the said minor is below 15 years old and acted without discernment the case shall be
dismissed. If the minor acted with discernment and is guilty the sentence is suspended
until the minor reaches age of majority.

It was also discussed that there is no hard and fast rule in determining probable cause. It
is dependent on the evident presented and will always be on the basis of whether such
facts or circumstances would excite the belief, in a reasonable mind, acting within the
knowledge of the prosecutor, that the person charged was guilty of the crime for which he
is prosecuted.

Once information is filed, the case shall be raffled to the prosecutors. It is to be noted that
the filing prosecutor does not necessarily also prosecute the case. As of this writing it is
stated that the system for Benguet is well within working order with enough prosecutors
to process and handle cases.

II. ) OBSERVATION

The system for the locality of Benguet appears to be effective and efficient with no
extrinsic signs of being overwhelmed as in the case in other parts of the country, There
also appears to be no signs of prejudice or partiality in terms of handling cases.

III.) RECOMMENDATIONS

The incorporation of online technology is not initiated or discussed. Such advancement


may prove to improve an already effective process further.
