MEMORANDUM

SUBJECT : REQUEST FOR COMMENTS AND ADDITIONAL INPUTS ON


THE PROPOSED COMPOSITION, FRAMEWORK,
STRATEGIES, AND INDICATORS FOR PDP CHAPTER 15.2
ON ENHANCE ADMINISTRATION OF JUSTICE

This pertains to the Assistant Secretary’s Memorandum dated October 05, 2022,
relative to the above-stated subject. In this regard, NBOO respectfully submits the
following comments, inputs and suggestions, to wit:

1. On the Planning Committee Composition

- NBOO respectfully suggests the National Commission of Indigenous


Peoples (NCIP) may be included as a member of the Planning
Committee under this Chapter taking into consideration the applicability
of customary laws and beliefs that may be inputs in the identification of
indicators and/or strategies.

- The Philippine National Police (PNP) is likewise suggested to be


included as a member of the Planning Committee.

2. On the Proposed Framework

- NBOO is amenable to the proposed Framework.

3. On Strategies

- NBOO agrees that the Katarungang Pambarangay should be


strengthened to prevent, if not reduced, the issuance of a Certification
to File Action in court.

- The up-scaled capacity development (capdev) program for Punong


Barangays, Barangay Secretaries and the Members of the Lupong
Tagapamayapa should be developed and implemented.

- The capdev, as a strategy, should not only focus on the repeated


discussion and presentation about mediation, conciliation and
arbitration, instead, the concerned barangay officials should also be

provided with the necessary skills and techniques on how to handle the
different types of complaints and the different types of disputing parties.

- It must be emphasized that the Bureau of Local Government


Supervision (BLGS) is mandated to establish and prescribe
guidelines in the administration of the Katarungang Pambarangay
(KP) Program, pursuant to Section 12(b) of Executive Order No. 262,
Series of 1987. On this basis, BLGS should establish a KP Program
that should include, among others, module development,
training/orientation for Lupon, performance monitoring and evaluation
and the provision of incentives awards, through the LTIA.

- Expanding the LTIA may also be considered as a strategy, which may


include provision of allowance for the best Lupong Tagapamayapa and
a capacity intervention to those Lupon with low performance.

- Strengthened collaboration and partnership with the Department of


Justice-Office for Alternative Resolution (OADR) in the implementation
of the KP Program may also be considered by BLGS.

- While the implementation of the KP Program is not within the mandate


of NBOO, the Bureau, for its part:

 Provides assistance to OADR in the implementation of its ADR-


KP related webinar series for the barangay officials, through the
issuance of a Memorandum Circular.

 Provides response to KP-related queries, based on the provision


of the Local Government Code of 1991.

 Assists the former Undersecretary for Barangay Affairs (USBA)


Martin B. Diṅo in the consolidation of the Annual KP Report
submitted by the Regions in 2020.

 Collaborates with the funding institution for the enhancement of


the 2014 KP Training Manual developed by the Department and
partner agencies under the EPJUST II Program.

- For the indicator on the settlement of cases/disputes filed before the


Lupong Tagapamayapa and the prescribed timeline:

 Response regarding this matter should be provided by BLGS as


the policy for this purpose was formulated by that Bureau.

 It must be noted that NBOO only assisted the former USBA in


the consolidation of KP reports, as part of the Undersecretary’s
accomplishment report to the then DILG Secretary.

 It is recommended that BLGS shall continue the monitoring of


the KP-related data, as the same, in our view, is critical in the

implementation of LTIA being handled by BLGS. Also, the
Resolution/Settlement rate may be part of the LTIA indicators.
NBOO may still continue to consolidate the data submitted by the
Region and the same shall be transmitted to BLGS, for its
information, analysis and/or enhancement.

 Attached is the Matrix on the 2021 KP Data submitted by the


Regional Offices and consolidated by NBOO.

4. On the Legislative Agenda:

- Standardization of the Honorarium of Lupon.
