MOTION TO REMAND RECORDS

COMES NOW APPELLEE CELIA E. LEUTERIO, by and through

the undersigned Law Offices, unto this Honorable Office, most

respectfully submits the instant Motion to Remand Records, and in

furtherance thereof courteously avers: That –

1. In view of the Order dated 04 July 2005 issued by this

Honorable Office dismissing appellant’s appeal with finality, and there

being no further motion for reconsideration or petition filed by said

appellant to overturn the dismissal, the judgment in the instant case

has already become final and executory.

2. Relative thereto, there is an imperative for the records of

this case that had already been forwarded to this Honorable Office, by

virtue of the HLURB’s Transmittal of Records dated 22 February 2005,

to be remanded back to the HLURB for the latter’s disposition and

further proceedings, specifically for execution purposes.

 3. The filing of the instant motion is not, in any way, intended

to delay the disposition of the cases but solely for the reasons

aforesaid.

PRAYER

WHEREFORE, above premises considered, it is most respectfully

prayed of this Honorable Office that the records of the instant case be

REMANDED to the HLURB at the soonest possible time.

OTHER RELIEFS, just and equitable under the foregoing

premises, are likewise most respectfully prayed for.
