Soalan WAJIB

1. “It is well known by the old Malay Law or custom of


Malacca, while the Sovereign was the owner of the soil,
every man had nevertheless the right to clear and occupy
all forest and waste land, subject to payment to the
Sovereign, of one-tenth of the produce of the land so
taken.”

Menurut Sir. P. Benson Maxwell, CJ di dalam kes Sahrip v. Mitchell


Anor (1870) Leic. 466 at page 468.

Dengan merujuk kepada kes di atas, bincangkan pemakaian Undang-


undang Adat tempatan di Negeri-negeri Selat. Jawapan anda harus
merujuk kepada perkembangan undang-undang di Negeri-negeri Selat dan
juga kes-kes yang relevan.

2. (a) Sebelum kedatangan British, Undang-undang Islam merupakan


undang-undang utama masyarakat Melayu di Negeri-negeri Melayu.
Bincangkan perkembangan Undang-undang Islam setelah kedatangan
British.

(b) Bincangkan perkembangan undang-undang Inggeris di Sarawak


dari tahun 1841 sehingga tahun 1888.

3. “For present purposes it appears that the Civil Law Ordinance,


Section 3, adopted English Law as administered at its effective
date, so that any subsequent march in England authority is not
embodied.”
Menurut Lord Russell of Killowen di dalam kes Lee Kee Choong v.
Empat Nombor Ekor (NS) Sdn. & Ors. [1976] 2 MLJ 93 di muka
surat 95.
Dengan merujuk kepada keputusan-keputusan mahkamah yang releven
dan Akta Undang-undang Sivil 1956, bincangkan pemakaian Undang-
undang Inggeris di Malaysia.

4. (a) Malaysia tidak mengamalkan konsep Ketinggian Parlimen kerana


kuasa Parlimen diberikan oleh Perlembagaan Persekutuan. Perlembagaan
Persekutuan merupakan undang-undang tertinggi di negara kita. Adakah
anda bersetuju dengan pernyataan ini? Bincangkan.

(b) Malaysia bukanlah negara Islam kerana Perlembagaan Persekutuan


hanya menyatakan bahawa Islam sebagai agama rasmi Persekutuan.

COMPULSORY Question

1. “It is well known by the old Malay Law or custom of


Malacca, while the Sovereign was the owner of the soil,

Per Sir. P. Benson Maxwell CJ, in the case of Sahrip v. Mitchell & Anor
(1870) Leic. 466 at page 468.

By referring to the above case, discuss the application of the Local


Customary Law in the Straits Settlements. Your answer should refer to the
legal developments in the Straits Settlements and also to the relevant
cases.

2. (a) Before the arrival of the British, Islamic Law was the main law of the
Malays in the Malay States. Discuss the development of the Islamic Law
after the arrival of British.

(b) Discuss the development of English law in Sarawak from the year
1841 until 1888.

discuss the appllication of English Law in Malaysia.

4. (a) Malaysia does not practice the concept of Supremacy of the


Parliament because the Parliament's power is conferred by the Federal
Constitution. The Federal Constitution is the supreme law of the country. Do
you agree with this statement ? Discuss.
(15 marks)

(b) Malaysia is not an Islamic state because the Federal Constitution


merely states that Islam is the official religion of the Federation. Discuss.
