Soalan WAJIB

1. “In my judgment, the English Powers of Attorney Act 1971 will


apply in this case in the State of Sabah by virtue of the
provision of s 5 (1) and (2) of the Civil Law Act 1956, that, the
issue or question of law now before the court is one relating to
“principal and agents “as specified in Section 5 (1) of the Civil
Law Act. “

Terangkan dengan merujuk kepada peruntukan-peruntukan statut dan
kes-kes yang diputuskan, penerimaan Undang-Undang Inggeris di bawah
peruntukan Seksyen 3, 5 dan 6 Akta Sivil 1956 ( Disemak 1971).

2. Bezakan dan analisakan penerimaan Undang-Undang Inggeris, dengan


merujuk kepada kes-kes yang diputuskan dan peruntukan-peruntukan
statut yang membentuk sistem perundangan sebelum kemerdekaan
Malaysia ke dalam Negeri-Negeri Selat, Negeri–Negeri Melayu (Bersekutu
dan Tidak Bersekutu), Borneo (Sabah dan Sarawak).

3. Di Mahkamah Persekutuan di dalam kes Haji Raimi Abdullah v Siti Hasnah


Vangarama Abdullah & Anor [2014] 4 CLJ 253, Ketua Hakim Mahkamah
Persekutuan Arifin Zakaria merujuk dengan persetujuan penghakiman
Mahkamah Rayuan di dalam kes Sukma Darmawan Sasmitaat Madja v
Ketua Pengarah Penjara Malaysia & Anor [1999]1 CLJ 481.

“Article 121 (1A) of the Federal Constitution does not exclude


the jurisdiction of the ordinary courts over all matters –
including offences under the Penal Code committed by
Muslims – which are also under the jurisdiction of the syariah
court. It only removes jurisdiction of the ordinary courts over
those matters which are within the exclusive jurisdiction of the
syariah court. “

Candidates are advised to spend the first 10 minutes reading the questions
carefully.

Answer TWO (2) questions only. Question 1 (COMPULSORY) and ONE (1)
other question.

The following statute is provided to the candidates:

COMPULSORY Question

Explain by reference to statutory provisions and decided cases, the
reception of English Law into Malaysia under the provisions of Section 3, 5
and 6 of the Civil Law Act 1956 ( Revised 1971).

Answer ONE (1) other question. Each question carries 30 marks.

2. Differentiate and analyse the reception of English law, by reference to case


law and statute, that shaped the legal system in pre-independence
Malaysia into the Straits Settlement, the Malay States (Federated and
Unfederated) and Borneo (Sabah and Sarawak).

3. In the Federal Court case of Haji Raimi Abdullah v Siti Hasnah Vangarama
Abdullah & Anor [2014] 4 CLJ 253 where Arifin Zakaria Chief Justice of the
Federal Court quoted with approval the judgement of the Court of Appeal
in Sukma Darmawan Sasmitaat Madja v Ketua Pengarah Penjara
Malaysia & Anor [1999] 1 CLJ 481

Comment on the above statement by reference to decided cases including
