OVERVIEW :
One of the most common maritime accidents is collision. The legal obligations to
claimants of the parties involved in collision are important to know in order to understand
the importance of careful exercise of duties and responsibilities of concerned parties.

LEARNING OUTCOMES : to understand the term “collision” and the salient provisions
of the International Convention that set uniform collisions rules.

LEARNING OBJECTIVES
1. The know the fault and sharing of liabilities of concerned parties arising from
collision
2. To have a common knowledge of the defenses from the claim for damages for
collision

A. Case Analysis: Analyze the case below and provide appropriate answers.
1. Two vessels named “M/S Mario and M/V Victor collided near the harbor of the
Port of Southampton, England. It was found that M/S Mario collided against M/V
Victor and both are found to be at fault. M/V Victor, however, is found to have
greater fault than M/S Mario. The total claims for damages amounted to
P750,000.00. M/S Mario’s liabilities were fixed at 25% and M/V Victor’s were
fixed at 75% due to greater degree of fault.

a. Compute the sharing of losses of the two vessels


M/S Mario
25 × 750,000 ÷ 100 = 187,500
M/V Victor
75 × 750,000 ÷ 100 = 562,500
b. If both ships are found to be equally at fault and will shoulder the cost of
damages on equal footing, compute for the sharing of losses.
M/S Mario
50 × 750,000 ÷ 100 = 375,000
M/V Victor
50 × 750,000 ÷ 100 = 375,000
