1 Base Date"”

The Base Date assumes that tenderers will not have had the opportunity, from
a practical point of view, to take account of any events which may have an
effect on their Tender and which occur less than twenty-eight days before the
date by which Tenders have to be submitted. Any such events occurring after
the Base Date will normally allow the Contractor to claim additional time
and/or of Costs (plus reasonable profit), if appropriate.

As per FIDIC (Redbook-1999)

“Base Date”- is referred in Sub-Clauses 4.10, 13.7, 13.8, 14.15(e),


17.5(b)(ii), and 18.2.(final paragraph)

So, what is the importance of this Base Date?

It is used throughout the Contract as a cut-off date.it is referred to as the date

A) As per SC 4.10 " the date when the Employer is obliged to have make
available certain Site data in his possession available to the Contractor

B) As per SC 13.7 ' the date after which changes in legislation affect the
Contractor’s performance of his obligation under the Contract ,will entitle the
Contractor to Claim

C) As per SC 13.8 ' The Base Date is the reference point for establishing the
base cost indices and reference prices for the purpose of operating the
adjustment mechanism.

D) AS per SC 14.15(e) ' The Base Date serves as the reference point for
establishing the applicable currency exchange rates if no rates of exchange
are stated

E) As per SC 17.5(b)(ii) ' The Contractor is indemnified by the Employer
against claims alleging infringement of intellectual or industrial property rights
as a result of the Works being used in certain circumstances, where such use
was not disclosed to the Contractor prior to the Base Date."

F) As per SC 18.2.(final paragraph) The Base Date is also relevant to


establishing the Contractor’s obligations to maintain insurance for the Works
against certain risks allocated to the Employer.
