MODULE 1 – INTRODUCTION & THE COMMISSION ON HIGHER EDUCATION
This module will walk us through the Philippine Medical Technology Act of 1969 (RA
5527), which will serve as the backbone of all our discussions for the first two terms of this
course. As a college student, it is just right to know the government agency responsible for
all the concerns of higher educational institutions. This module will allow us to learn the
composition, powers, and functions of the Commission on Higher Education.

MODULE OBJECTIVES

Overview of Republic Act No. 5527


Republic Act (R.A.) No. 5527, known as the Philippine Medical Technology Act of 1969,
was approved on June 21, 1969. This is an act requiring the registration of medical
technologists, defining their practices, and for other purposes related to the profession. This
act was amended by R.A. 6132 (approved on August 31, 1970), Presidential Decree (P.D.)
498 (approved on June 28, 1974), and P.D. 1534 (approved on June 11, 1978). This law is
composed of 32 sections that contain the following:

We are to discuss the specific contents of the different sections of R.A. 5527 together
with other pertinent laws in chronological order, as presented above.

Definition of Terms (Section 2 of RA 5527)


For this section, we are to understand the definition of pathologists, medical
technologists/ medical laboratory scientists, medical laboratory technicians, and the
practice of medical technology.

Pathologist, according to Section 2 or RA 5527, is a duly registered physician who is


specially trained in methods of laboratory medicine, or the gross and microscopic study and
interpretation of tissues, secretion, and excretions of the human body and its functions to
diagnose disease, follow its course, determine the effectivity of treatment, ascertain the
cause of death and advance medicine through research. CMO 6 s. 2008 simplified the
definition as a duly registered physician who is specially trained in clinical and/or anatomic
pathology certified by the Philippine Board of Pathology.
Medical Technologist/ medical laboratory scientist is a person who engages in the
work of medical technology under the supervision of a pathologist or licensed physician -

With these, therefore, we can deduce that medical technologist/ medical laboratory
scientist is a person who graduated the prescribed course, passed the medical technology
board examination, registered by the PRC, and engaged in the practice of medical
technology under the supervision of a pathologist. The prescribed courses include Bachelor
of Medical Technology, Bachelor of Medical Laboratory Science, Bachelor of Science in
Medical Laboratory Science, and Bachelor of Public Health. At present, medical technology
practice is under the supervision of pathologist such that the statement in R.A. 5527 that
states, licensed physician authorized by the Department of Health in places where there is
no pathologist is no longer applicable.

Medical laboratory technician is a person certified and registered with the Board as
qualified to assist a medical technologist and/or qualified pathologist in the practice of
medical technology. The qualifications of medical laboratory technician will be discussed in
Module 2.

Practice of Medical Technology. Section 2 of R.A. 5527 clearly states that a person
shall be deemed to be in the practice of medical technology when a fee, salary, or other
compensation or reward is paid or given, directly or indirectly, through any of the following
professional services for the purpose of aiding the physician in the diagnosis, study and
treatment of diseases and in the promotion of health in general. These practices include:
1. examination of tissues, secretions and excretions of the human body and body fluids
by various electronic, chemical, microscopic, bacteriologic, hematologic, serologic,
immunologic, nuclear, and other laboratory procedures and techniques either
manual or automated;
2. blood banking procedures and techniques;
3. parasitologic, mycologic and microbiologic procedures and techniques;
4. histopathologic and cytotechnology; provided that nothing in this paragraph shall
inhibit a duly registered medical laboratory technician from performing
histopathology techniques and procedures;
5. clinical research involving patients or human beings requiring the use of and/or
application of medical technology knowledge and procedures;
6. preparations and standardization of reagents, standards, stains, and others, provided
such reagents, standards, stains, and others are exclusively for the use of their
laboratory; m not for commercial use
7. clinical laboratory quality control;
8. collection and preservation of specimens;

of a profession already regulated by existing law, shall not be subject to the provisions of the
last four numbers (5-8) if the performance of such acts or services is merely incidental to his

D. Commit to moral ascendancy that eradicates corrupt practices, institutionalizes transparency and
accountability and encourages participatory governance in the Commission and the sub-sector.

The commission is composed of five (5) full-time members with 4 years term. The
President of the Philippines appoints a Chairman of the Commission and four (4)
commissioners. The qualifications are as follows:
1. holders of earned doctorate(s),
2. actively engaged in higher education for at least ten (10) years,

In no case shall any and all of the Commissioners appoint representatives to act on
their behalf (Section 4, R.A. 7722).

The powers and function of the commission are enumerated in Section 8 of R.A. 7722.
1. Formulate and recommend development plans, policies, priorities, and programs on
higher education;
2. Formulate and recommend development plans, policies, priorities, and programs on
research;
3. Recommend to the executive and legislative branches priorities and grants on higher
education and research;
4. Set minimum standards for programs and institutions of higher learning
recommended by panels of experts in the field and subject to public hearing, and
enforced the same;
5. Monitor and evaluate the performance of programs and institutions of higher learning
for appropriate incentives as well as the imposition of sanctions such as, but not
limited to, diminution or withdrawal of subsidy, recommendation on the downgrading
or withdrawal of accreditation, program termination or school course;
6. Identify, support and develop potential centers of excellence in program areas
needed for the development of world-class scholarship, nation building and national
development;
7. Recommend to the Department of Budget and Management (DBM) the budgets of
public institutions of higher learning as well as general guidelines for the use of their
income;
8. Rationalize programs and institutions of higher learning and set standards, policies
and guidelines for the creation of new ones as well as the conversion or elevation of
schools to institutions of higher learning, subject to budgetary limitations and the
number of institutions of higher learning in the province or region where creation,
conversion or elevation is sought to be made;
9. Develop criteria for allocating additional resources such as research and program
development grants, scholarships, and the other similar programs: Provided, that
these shall not detract from the fiscal autonomy already enjoyed by colleges and
universities;

10. Direct or redirect purposive research by institutions of higher learning to meet the
needs of agro-industrialization and development;
11. Devise and implement resource development schemes;
12. Administer the Higher Education Development Fund, as described in Section 10 of
R.A. 7722, which will promote the purposes of higher education;
13. Review the charters of institutions of higher learning and state universities and
colleges including the chairmanship and membership of their governing bodies and
recommend appropriate measures as basis for necessary action;
14. Promulgate such rules and regulations and exercise such other powers and functions
as may be necessary to carry out effectively the purpose and objectives of R.A. 7722;
and

15. Perform such other functions as may be necessary for its effective operations and for

programs, the commission reconstitute and/or organize technical panels for different
disciplines/program areas. The technical panels assist the commission in setting standards
and in program and institution monitoring and evaluation. The technical panels shall be
composed of senior specialists or academicians to be appointed by the Commission
(Section 12, R.A. 7722). As prescribed by CMO 2011-05, each technical panel is composed
of a chairperson (1-year term) and technical committee members (2 years term).

R.A. 5527 Sections 3 to 5, mentioned the Council of Medical Technology Education.


This Council is now known as the Technical Panel in Medical Technology Education (TPMTE).
The provision of R.A. 5527Section 3 on the composition is no longer applicable in compliance
with the guidelines of CHED. The composition of TPMTE at present are:

R.A. 5527 Section 5 enumerated the functions of the TPMTE with minor revisions in
compliance with CHED. The functions are as follows:

1. To recommend the minimum required curriculum for the course of medical

medical technology course in each school, taking into account the student-instructor
ratio and the availability of facilities for instruction.
3. To recommend closure of medical technology schools which are found to be
substandard.

4. To require all medical technology schools to submit an annual report, including the
total number of students and instructors, list of facilities available for instruction, a list
of their recent graduates and new administrations, on or before the month of June.
5. To inspect, when necessary, the different medical technology schools in the country
in order to determine whether a high standard of education is maintained in said
institutions.
6. To promulgate, and prescribe, and enforce necessary rules and regulations for the
proper implementation of the foregoing functions.

In the performance of the powers and functions of CHED, academic freedom of


universities and colleges is guaranteed. However, all school under the supervision of CHED
shall abide concerning the:
1. minimum unit requirements for specific academic programs
2. general education distribution requirements as may be determined by CHED
3. specific professional subjects as may be stipulated by the various licensing entities
(Section 13, R.A. 7722)
