CONTRACT OF LEASE

This Contract of Lease made and entered into in Quezon City, Metro Manila this
_______ day of November 2021 by and between:

JACKIE LOU A MASLANG, of legal age, Filipino, and a resident of _____________,


Philippines, (hereinafter referred to as the "LESSOR");

- and –

__________________________ of legal age, Filipino, married, and a resident of


_____________, Philippines, (hereinafter referred to as the "LESSEE");

 
WITNESSETH That:

WHEREAS, the LESSOR is the owner and lawful possessor of Unit 11312 of


Fountain Breeze Condominium situated at Sucat Paranaque City, Philippines with a
total floor area of ___________ square meters, more or less, and covered presently by
Condominium Certificate of Title (“CCT”) No. ________, issued by the Register of
Deeds for the City of ________________ (the “Leased Premises”);

WHEREAS, the LESSEE has offered to lease the Leased Premises from LESSOR,
and the LESSOR agrees to let the LEASED PREMISES to LESSEE, subject to the terms
and conditions herein set forth.

NOW, THEREFORE, for and in consideration of the terms and conditions


mutually agreed upon by the parties, the LESSOR hereby lease unto the LESSEE, the
above-described LEASED PREMISES subject to the following terms and conditions, to
wit:

I. LEASE PERIOD

1. The term of this lease shall be for a period of 12 months to commence on June 10,


2022 and expiring on June 10, 2023 (the LEASE PERIOD”), and shall be
renewable only upon written agreement of both parties.

2. LESSEE shall have the option to renew the lease and may exercise such option by
notifying the LESSOR in writing at least fifteen (15) calendar days prior to the
expiration of the LEASE PERIOD. Any such renewal shall be subject to such
terms and conditions agreeable to both the LESSEE and LESSOR.

II. RENT, ASSOCIATION DUES AND UTILITY BILLS


1. For each month during the LEASE PERIOD, LESSEE shall pay LESSOR the
Monthly Rent in the amount of Twelve Thousand Pesos (Php 12,000.00)
exclusive of Association Dues and payment for Utilities.

2. LESSEE shall pay its own utilities (e.g. water, cable TV, electrical, internet
connection) that may be billed against him or the unit as a result of the LESSEE’s
use or consumption of such utilities.

3. LESSEE shall likewise pay the Association Dues which may be billed against the
unit as payment for the maintenance of common areas.

4. Upon execution by both parties of this Contract, the LESSEE shall comply with
the following:

Payment of One (1) Month Security Php 16,000.00 payable upon execution
Deposit of Contract
One (1) Month Advance plus Php 16,000.00 payable upon execution
Association Dues of Contract
Eleven (11) Post-dated Checks Php 16,000.00 payable on every tenth
covering the rental period of July 10, of the year from July 2022 to June 2023
2022- June 10, 2023
Twelve (12) monthly payments for As may be assessed by the
association dues Condominium Association

Note: The tabulated fees are exclusive of the above-mentioned association dues
and utility dues which shall be paid every billing period.

5. For rental arrears, LESSEE shall pay a three percent (3%) penalty per month of
the unpaid balance, until the entire amount due and owing to the LESSOR is
fully paid.

6. If the check or any of the checks issued by the LESSEE is dishonored, it shall be
an automatic ground for termination of the Lease Contract.

III. SECURITY DEPOSIT

1. Upon execution of this Contract, LESSEE shall remit to LESSOR a non-interest


bearing security deposit in the amount of Sixteen Thousand Pesos (Php
16,000.00), which amount is equivalent to one (1) month’s Monthly Rent.

2. The Security Deposit shall: a) answer for any and all damages to the Leased
Premises (including the furniture, fixtures, improvements, appliances, etc.
owned by the LESSOR) due to fault or negligence of the LESSEE; b) answer for
any unpaid bills for electricity, water, telephone, cable TV, internet services and
other charges on the Leased Premises; c) serve as security for the return of the
Leased Premises in proper condition; and d) for LESSEE’s due observance of and
faithful compliance with the terms and conditions of this Contract.

3. The Security Deposit shall not, during the Lease Period or any extension or
renewal thereof, be used to offset any monthly rent or other payments due to
LESSOR from LESSEE, and shall remain intact for the entire duration of the
Lease Period.

4. The Security Deposit shall be refundable to the LESSEE, without any interest
thereon, within thirty (30) days from the expiration of the Lease Period or any
extension or renewal thereof, deducting therefrom all duly receipted amounts
that might be then owing to LESSOR from LESSEE as provided for in this Section
which includes unpaid utility bills and amounts needed for the repair of the
Leased Premises, if any.

IV. MAINTENANCE AND REPAIR

1. During the entire duration of the Lease Period, all extraordinary or major repairs
in the Leased Premises shall be for the exclusive account of the LESSOR, except
when the damage was caused by the LESSEE.

For purposes of this Section, “major repairs” shall mean repairs that cost more
than Three Thousand Pesos (Php 3,000.00) per item or occurrence, and/or those
for the conservation and prevention of the Leased premises, as well as those
necessitated by structural defects. Any repair that costs Three Thousand Pesos
(Php 3,000.00) or less per item or occurrence, and/or those which include the
repair of leaks in toilet bowls, sinks, and/or faucets, the replacement of bulbs,
ballasts, and fuse, and the like shall be deemed a minor repair and shall be for
LESSEE’s account.

2. The LESSEE shall pay for the expenses needed for the maintenance of the Air
conditioner, refrigerator and other appliances that belongs to the owner and
which were placed in the unit for use of the LESSEE.

V. ALTERATION, ADDITIONS, IMPROVEMENTS

LESSEE shall not make any alterations, installations, additions, and/or


improvements upon the Leased Premises without prior approval of the LESSOR.

VI. SUB-LEASE  

The LESSEE shall not directly or indirectly sublet, allow or permit the leased
premises to be occupied in whole or in part by any person, form or corporation,
neither shall the LESSEE assign its rights hereunder to any other person or entity
and no right of interest thereto or therein shall be conferred on or vested in
anyone by the LESSEE without the LESSOR'S written approval.

VII. USE OF LEASED PREMISES

1. LESSEE shall use the Leased Premises exclusively for residential purposes
and it is thereby agreed that the Leased Premises will be occupied by those
authorized occupants conveyed to the LESSOR upon the execution of this
Contract.

2. For this purpose, the following are the authorized occupants of the Leased
Premises:

3. The Leased Premises shall not in any instance be used for any illegal, immoral
or commercial purposes.
4. LESSEE hereby acknowledges that the Leased Premises is in good and
tenable condition and agrees to keep the same in a clean, presentable and
sanitary condition in order to maintain the high-quality standards of the
building.

VII.  FORCE MAJEURE

If whole or any part of the leased premises shall be destroyed or damaged by


fire, flood, lightning, typhoon, earthquake, storm, riot or any other unforeseen
disabling cause of acts of God, as to render the leased premises during the term
substantially unfit for use and occupation of the LESSEE, then this lease contract
may be terminated without compensation by the LESSOR or by the LESSEE by
notice in writing to the other.

VIII. LESSOR'S RIGHT OF ENTRY

The LESSOR or its authorized agent shall after giving due notice to the LESSEE
shall have the right to enter the premises in the presence of the LESSEE or its
representative at any reasonable hour to examine the same or make repairs
therein or for the operation and maintenance of the building or to exhibit the
leased premises to prospective LESSEE, or for any other lawful purposes which it
may deem necessary.
 
IX. EXPIRATION OF LEASE 

At the expiration of the term of this lease or cancellation thereof, as herein


provided, the LESSEE will promptly deliver to the LESSOR the leased premises
with all corresponding keys and in as good and tenable condition as the same is
now, ordinary wear and tear expected devoid of all occupants,
movable furniture, articles and effects of any kind. Non-compliance with the
terms of this clause by the LESSEE will give the LESSOR the right, at the latter's
option, to refuse to accept the delivery of the premises and compel the LESSEE to
pay rent therefrom at the same rate plus Twenty Five (25) % thereof as penalty
until the LESSEE shall have complied with the terms hereof.  The same penalty
shall be imposed in case the LESSEE fails to leave the premises after the
expiration of this Contract of Lease or termination for any reason whatsoever.

X. JUDICIAL RELIEF

Should any one of the parties herein be compelled to seek judicial relief against
the other, the losing party shall pay an amount of One Hundred (100) % of the
amount clamed in the complaint as attorney's fees which shall in no case be less
than P50,000.00 pesos in addition to other cost and damages which the said party
may be entitled to under the law.

XI. VALIDITY OF CONTRACT

This CONTRACT OF LEASE shall be valid and binding between the parties,


their successors-in-interest and assigns.
