AFFIDAVIT OF EXPLANATION

I, ANALIZA VIAÑA HERRERA, of legal age, single, Filipino citizen and presently residing at
202 Malagasang II-C, Imus City, Cavite, after having been duly sworn to according to law depose and
say;

1. That I am one of the legal heirs of the late GAUDENCIO MAGSINO HERRERA who died last
September 18, 2018 at Emilio Aguinaldo Memorial Hospital, Dasmariñas City, Cavite, in which I
as the surviving legal spouse executed a certain instrument/document entitle BOND TO
ANSWER CLAIMS UNDER SECTIONS 4 & 5 RULE 74, OF THE RULES OF COURT –
HEIR’S BOND noted and entered by Atty. Bansalan B. Metilla with Doc. No. 83, Page No. 18,
Book LXVII, Series of 2022;

2. That sometime in 2022, I transacted with the good office of the Register of Deeds (ROD) when I
found out that all my original copies of Heirs Bond, Electronic Certificate of Authorizing
Registration (ECAR), Extra-Judicial Settlement of Estate, etc., under rules and regulations of
the Register of Deeds were all collected for registration;

3. Consequently, the ROD will release and issue a duplicate copy of the same certified by the ROD
and that the Certified True Copies will be stamped as received by the ROD, whereas, the said
CTC’s are the documents that will be forwarded to our authorized bank/s for requirement
purposes;

4. That I am executing this affidavit to attest to the truthfulness of the above-mentioned statements
and as a requirement for the adjudication of the above-mentioned amount be registered to the
Register of Deeds (RD), true and correct with the best of my knowledge.

IN WITNESS WHEREOF, I have hereunto set my hand and affix my signature November 16,
