Types of Offer

General Offer
The Carlill v Carbolic Smoke Ball Co.

• Company published advertisements claiming that it would pay £100 to

anyone who got sick with influenza after using its product according to the

instructions set out in the advertisement

• Mrs. John saw the advertisement, bought one of the balls and used

according to the instructions and she contracted the flu and accordingly

claimed £100 from the Carbolic Smoke Ball Company

• Held, she could recover money as she had accepted the offer

Specific Offer
• X offers to buy car from Y for ₹10 lakh

• Z communicates acceptance

• Held, No person other than Y can accept this offer

Exception:

A duly authorized agent of offeree can accept the offer

Offer through Post

On 1/6/1988

A→ B: offering to sell his car for ₹1 lakh

On the same day

B→ A: offering to buy A’s car for ₹1 lakh

Standing Offer
• An offer which is allowed to remain open for acceptance over a period of

time is known as standing or continuing or open offer.

• Tenders that are invited for supply of goods is a kind of standing offer.
