DEED OF GRANT OF USUFRUCTUARY RIGHTS

KNOW ALL MEN BY THESE PRESENTS:


This agreement, made and entered into the City of Baybay and between:

SPOUSES JIMMY R. ROSILLO and ERLINDA P. ROSILLO,


both of legal age, married, Filipino citizens and residents of Brgy. Guadalupe,
Baybay City, herein referred to as the GRANTOR,

-and-

ALBERT P. ROSILLO, of legal age, married, Filipino citizen


And a resident of Brgy. Guadalupe, Baybay City, herein referred to as the
GRANTEE-

W I T N E S S E T H : that-

WHEREAS, the GRANTOR is the owner of a portion containing an area of ONE


THOUSAND NINE HUNDRED SEVENTY SIX (1,976) SQUARE METERS of land located at
Sitio Tab-ang, Brgy. Kilim, Baybay City, Leyte, designated as Lot No. 6947-B embraced by
Transfer Certificate of Title No. T-21516 of the Registry of Deeds for the province of Leyte.

WHEREAS, the GRANTOR, desires to give the GRANTEE the right of usufruct over
the said portion containing an area of 1,976 square meters to use and enjoy the said property.

NOW, THEREFORE, for and in consideration of public service and their mutual

agreement, covenant and stipulations hereinafter set forth, the GRANTOR hereby transfers and
conveys unto the GRANTEE, by way of USUFRUCT the above-mentioned portion of the above-
described parcel of land, subject to the following-

TERMS AND CONDITIONS

1. This Grant of Usufruct shall be valid for a period of twenty (20) years from the
date of execution of this deed, subject to the condition that the GRANTEE shall
actually be in possession of the aforesaid portion of the property, for the sole purpose
of using in the establishment of BASTI’S VEGETABLE FARM.

2. During the existence of this Agreement the GRANTEE shall not pay any lease
rental on the portion subject of this Agreement.

3. The GRANTEE shall pay all the licenses, permits, duties, levies and such other
charges as the Government or any of its instrumentalities and agencies may impose
by reason of and arising out of this Agreement and its implementation.

4. The GRANTEE shall not lease any part or portion of the premises or the whole
thereof, to any person or entity without the express consent of the GRANTOR.

5. The GRANTOR hereby covenants with the GRANTEE that the latter shall
peacefully hold and enjoy the full use and possession of the premises during the
period of the grant.
6. The GRANTOR hereby warrant peaceful possession of the said portion subject of
this Agreement for the said period of twenty (20) years from date of execution of this
Agreement and that after the said period, the GRANTEE shall immediately turnover
the possession to the GRANTOR;
