DESSERT
1.1 Minimum amount of Php. 25,000.00 for the month of January 2022 to November 2022.
Minimum amount of Php. 40,000.00 for the month of December 2022.
1.3 The client or any person shall not be permitted to bring and serve food and/or beverages unless prior approval is given to SII's
(Super.Ice, Inc. or The Creamery Catering) representative.
1.4 A waiver form shall be accomplished and signed by the client to release the caterer from any form of liability such as and not
limited to food poisoning, etc.
1.5 SII cannot be held responsible for any untoward accident or injury that may occur on account of the food and/or beverages
brought and/or served by any person or entity, other than SII or any of the latter's employees or representatives.
1.6 If in case CLIENT will bring in their own food and/or beverages, client must provide their own container and a separate table for it.
SII (Super.Ice, Inc. Or The Creamery Catering) will not be providing tables, linens, chaffing dishes, serving plates nor utensils for
food and/or beverages that the client will be bringing in.
1.7 If there are no dessert and drinks in the package, this means no dessert utensils and/or glasses will be provided by the CATERER.
1.8 In case that the client will be having wines, the said wine must only be turned over to the Event’s Team Leader during and/or
before the schedule.
2. MODE OF PAYMENT
2.1 DEPOSIT
A non-refundable deposit of Twenty Thousand Pesos (P20,000.00) is required upon confirmation to secure a slot and price
quoted. This amount shall be deductible from the total contract price.
2.3 Other incidental charges to be settled immediately after the event, which shall be made in cash.
3.2 The client hereby acknowledges that the number of guests stated in the contract shall not be subject to reduction and agrees to
pay in full even if the number of guests in attendance is less than the number of guests stated in the contract.
3.3 Downsizing of the total number of persons guaranteed with justifiable reason must be made 2 weeks prior to event date, which is
subject for approval of SII Management.
4. buffer of food
4.1 Buffer for food is only intended for guests going back and is not for additional attendees. 10% quantity is applied to bookings good
for 99 persons and below; and 10 persons for guests over 100.
4.2 To avoid food shortages, please note that the caterer is mandated to only serve food and drinks alloted per agreed number of PAX.
Buffet style does not mean that it is an "eat all you can buffet".
5. cancellation
5.1 All cancellations shall be made at least two (2) weeks prior to the scheduled event date to avoid cancellation charges. A written
cancellation shall be submitted and will be entertained by our Banquet Sales Associate.
The Caterer shall not be held in any way liable for its failure to execute, comply or extend with its undertakings under this contract
for reasons or causes beyond its control, including but not limited to the following:
a. Civil disturbance
b. Strikes
c. Sabotage
d. Weather conditions
e. Other similar forms of unrest.
7. POSTPONEMENT AND/OR CANCELLATION DUE TO TYPHOONS
7.1 In case of inclement weather or typhoon which has been forecasted or made known to the public to make a landfall on the
scheduled date of the event, the CLIENT is hereby given an option to postpone or proceed with the event.
7.2 Should the CLIENT seek for postponement of the said event, it is understood that the catering service shall proceed within 7 days
from the original schedule of event unless the CATERER is already fully booked.
7.3 If the CLIENT voluntarily and knowingly opt to proceed with the event despite the weather disturbance on the date of the event,
the CATERER shall exert reasonable effort to comply on its obligations.
7.4 However, in the event that the CATERER was prevented by heavy rainfall or flood, despite reasonable efforts to fulfill its catering
services and in accordance with the directive of the CLIENT to proceed with the event despite of the weather forecast, it's
obligations under this Catering Contract is deemed accomplished.
7.5 Hence, the CATERER shall have the right to duly charge the CLIENT the cost of the entire contract taking into consideration the fact
that the former had already fully spent for the preparation of the menu agreed.
7.6 The CLIENT shall the right to secure and/or obtain the cooked food which was paid but which were not turned over / set up by the
CATERER due to the inclement weather/flood.
8.1 The client agrees to pay additional 10% of the gross contract price should the event falls on a declared Public Holiday.
8.2 For loss or missing items such as utensils, shot glasses, table linens, etc. CLIENT shall be charged accordingly. For loss or missing
centerpieces per table that were borrowed and used by the CLIENT, an Php 8,000.00 to Php 10,000.00 charge will be imposed by
the CATERER.
8.3 Should the Client require a centerpiece, tables, chairs with cover and other equipment; cost will be charge based on our rental
rates. There is no assurance that we can provide request due to availability of the item. However, the Client agrees that any lost or
damages of the centerpiece, tables, chairs with cover, linens and other equipment rented will be charged accordingly on the
client’s account.
In case the CLIENT is a juridical entity, i.e. corporation, partnership, government or non government organization, the person(s) signing
for and in behalf of, or otherwise representing the CLIENT, shall be jointly and severally liable with the juridical entity which he/she
represents for the enforcement of the provisions of this AGREEMENT, in the event that such representative of the CLIENT-juridical entity
shall thereafter be proven to have exceeded his / her authority, or otherwise in bad faith, in dealing with the CATERER.
