DEMAND TO VACATE
Mr. Castillo,

This letter has been issued to you on behalf of my client, Mrs. Edna and Mr. Pedro Reyes
(Spouses Reyes).

The concern is due a lease contract you entered into for the use of my clients’ property,
specifically a condominium unit designated Unit 1010 at Berkeley Residences, located at J. Escaler St.,
corner Katipunan Avenue, Quezon City (Berkeley Condo Unit). The lease agreement stipulated that for a
twelve-month period, my clients would be paid the amount of Twenty Thousand Pesos (PhP 20,000) per
month as rental payments, from June 2022 to May 2023. The agreement also stipulates a provision in the
case of default in payment on your part, specifically, that your deposit of Twenty Thousand Pesos would
be forfeited as liquidated damages in case of such default.

However, the rent due for the months of November and December 2022, as well as January 2023
have gone unpaid, specifically three of the postdated checks issued by your person have been dishonored
by BDO for insufficiency of funds from BDO Current Account No. 1-2345-6.

Sometime after December 15, 2022, you were notified through SMS of the dishonor of the
December 2022 rent check, but despite such notice you have failed to respond to my clients’
communications.

As such, this letter serves as a FINAL AND FORMAL LETTER OF DEMAND for you, Mr.
Jay Castillo, to PAY in full of the amount of Sixty Thousand Pesps (PhP 60,000.00), and to VACATE
the premises of the Berkeley Condo Unit within 10 days. Failure to comply with these demands will
constrain us to file the appropriate legal action against you.
