Issue – 1: WHETHER RAGNELL VIOLATED THE TREATY OBLIGATIONS IN

LAUNCHING “OPERATION SHINING STAR” AND ITS ATTACKS ON BOTH NANT


GATEWAY AND COMPOUND ARDAN AND THUS PAY REPARATIONS TO
AGLOVALE FOR THE DEATHS OF THE EIGHT AGLOVALEAN NATIONALS.

Article 14 of the Trilateral Treaty of Lasting Peace clearly states that for the duration of the
lease the parties commit to the demilitarization of the Clarent Belt and only the peacekeeping
monitoring forces of the kingdom of Aglovale and only the Police forces of the State of
Ragnell, which are charged with the responsibility of maintaining law and order.
Article 15: Access to the Eamont Thruway and Tintagel Port 221
The state of Ragnell undertakes that, during the term of the Lease, it shall protect and
preserve the integrity of the Eamont Thruway and Tintagel port, which it acknowledges are
vital to the economy of the Kingdom of Aglovale. The undertaking includes any
improvement to the facilities that may be carried out during the term of the Lease.

whereas the Ragnell launched the operation shining star which was a military campaign
aimed in wiping out the UAC terrorist which resulted in the Armoured vehicles and
Ragnellian military battalions entered the Belt and hence was a violation of the Trilateral
Treaty of lasting Peace in accordance with Article 14.

This act was an unwarranted act of aggression and an egregious breach of the Treaty. This act
was not a act of self-defence which can be used by the Ragnell and do not justify the use of
armed forces.
Even when on 22nd July 2021 the UN Security Council Convened an emergency meeting it
was a impetus that the Ragnell’s desire is to create a pretext justifying withdrawal from the
Peace Treaty.

On 22nd December 2021, Ragnell Destroyed the Nant Gateway completely just on a mere
basis of secret information that too from his ally Etna that UAC fighters were making their
wat for a surprise attack indicating towards a baseless self-defence tactic used by the Ragnell
to justify the attack on completely destroying the Nant Gateway and halting all the movement
out and in of the coast.

Because of this Attack there were various Aglovalean Civilians who had not been able to
escape from the park and now are isolated and extremely vulnerable. This attack on a
humanitarian Corridor was an Act of violating the treaty and as well as collective punishment
that is unacceptable under the above-mentioned international humanitarian laws.
In March 2022, Ragnell authorized a bombing raid on the four buildings of the Compound
Ardan on false contentions of the Compound being used as a ground attack whereas later no
ammunition was stored in the Warehouse and there were women and children out of which 8
were Aglovalean aid workers who were unable to leave the Belt.
Ragnell has committed “repeated war crimes” and is responsible for killing civilians therefore
should be liable under the Humanitarian Customary laws and also for the reparation to the
appellants for the loss they suffered because of these attacks which was based on false
contentions of self-defence.

Issue 2: WHETHER RAGNELL VIOLATED ITS TREATY OBLIGATIONS BY


EMPLOYING CAPTURED UAC FIGHTERS IN THE TRANSPORTATION OF
CONTAMINATED PLASTIC WASTE, AND BY DETAINING THEM IN CAMLANN
CORRECTIONAL CENTRE.
The Ragnell’s forces captured more than 400 UAC fighters held at Fort Caerleon, Ragnell
ordered UAC detainees in Fort Caerleon to help load the waste onto ships.

ISSUE 3: WHETHER AGLOVALE VIOLATED ITS TREATY OBLIGATIONS BY


UNILATERALLY IMPOSING SANCTIONS AGAINST RAGNELL AND RAGNELLIAN
NATIONALS AND THUS IMMEDIATELY WITHDRAW THOSE SANCTIONS,
RELEASING/RETURNING ALL RAGNELLIAN PROPERTY, AND COMPENSATE
RAGNELL FOR THEIR IMPACT.
In April 2022, Aglovale’s Parliament enacted sanctions legislation against Ragnell such as
freezing bank accounts, belonging to Vortigern, his cabinet ministers, and senior RPP
members and financial supporters and seizing the assets of anyone of Ragnellian or other
nationality engaged in direct or indirect attempts to circumvent these sanctions; Imposing
travel bans on these same individuals; freezing the funds of Ragnell’s central bank and ten
other major Ragnellian banks operating in Agolvale’s territory; and Prohibiting companies
incorporated in Aglovale and Aglovalian citizens from entering into new contracts with,
providing goods or services to, or receiving goods or services from, business enterprises
operating in Ragnell’s industrial, aviation, transportation or security sectors , also voided
contracts with their Ragnellian partners. At Aglovale’s urging several of its allies adopted
similar measures. These moves were fully complying with the sanctions resolution.

The preamble of the treaty aims to achieve a just, lasting, and comprehensive peace on the
Gais Peninsula, and in particular to avoid any future threat or use of force.

Article – 2
1) The Parties shall apply amongst themselves the provisions of the Charter of the United
Nations and the principles of conventional and customary international law governing
friendly relations among states.
2) The Parties shall adhere to and be bound by all applicable of human rights and
international humanitarian law, and shall take all necessary measures to prevent violations of
those principles.
3) In their economic relations, the parties shall work to promote economic advancement,
social welfare, and free trade, in accordance with all applicable principles of international
law, throughout the Gais Peninsula.
ISSUE 4: WHETHER AGLOVALE VIOLATED THE TREATY BY REFUSING TO
COOPERATE IN GOOD FAITH IN THE MANAGEMENT OF THE PLASTIC WASTE,
WHEREAS RAGNELL COMPLIED WITH ITS OBLIGATION UNDER THE TREATY
WHEN IT WAS FORCED BY THE REFUSAL TO EXPORT THE WASTE TO ETNA
FOR PROCESSING AND DISPOSAL.
The main waste treatment plant of the plastics conglomerate was the site of the day-long
fighting between UAC units and Ragnells’s forces. During which the central floor collapsed,
rendering the facility inoperative. Due to which plastic waste, such as non-biodegradable and
unsorted synthetic polymers including polyethylene and Polyvinyl chloride began to
accumulate. This resulted in large accumulations of medical waste found to be contaminated
by the bacterial pathogens clostridioides difficile and methicillin-resistant Staphylococcus
aureus. Even after all this the ragnellian forces didn’t stop the attacks and it was due to fault
on their part that the Environmental condition kept on denigrating in the coast.

Article 28 that is PART – IV of the Trilateral Treaty talks about the Environmental
Development.

Article 28: All parties commit to the protection of human health and the physical and marine
environment within and surrounding the Gais peninsula, including the Clarent Belt and
Tintagel Part Industrial District. Parties shall use their best practicable means to prevent, or to
remedy. Environmental pollution and harm, inter alia by compliance with all relevant rules of
international law. The parties agree to take whatever steps are necessary, or are reasonable
requested by other parties to this Treaty, to cooperate in good faith in reducing the risk and/or
the impact of significant harm from environmental pollution.

Aglovale and Ragnell met in Stirling to discuss the negotiation on the on-going
environmental issues in the coast but they were not able to reach to a mutual agreement.
Despite all the attacks that were still continuing in the coast by the Ragnell. The unnecessary,
indiscriminate, and inhumane bombing of Nant gateway and other acts of war crime
repeatedly led to rethink the future cooperation with the Ragnell and hence no treaty has been
violated on the first part the condition of the environment has reached to this stage because of
the reckless and unnecessary acts of Ragnell.
Moreover, on 20th January 2022, Ragnell signed a agreement with etna to export all the
accumulated plastic waste in the belt for the disposal. The International Landfills Solutions
Alliance stated that contrary to what Etna’s commitment was they were not equipped to
handle the large shipments from Ragnell, and used unsustainable and environmentally
harmful practices, including incineration and dumping of potentially infectious plastic waste
into open landfills and the ocean further violation the treaty as well as the Stockholm
conventions which etna was a party to and since Ragnell entered into an agreement hence
violating the trilateral treaty. They themselves agreed on the fact that the agreement with the
Etna was not an ideal one and still they went ahead with that.
