SYNOPSIS & DATES AND EVENTS

The above Writ Petition has been filed praying for a Writ of Certiorarified
Mandamus calling for the records relating to the order dated 24.07.2021 in
Ref: CA/5/2021/Academic-Eligibility of the second Respondent herein and
quash the same and consequently direct the Respondents 2 and 3 to consider
the Petitioner for admission to B. Arch Course for the academic session 2021-
2022 as per section 4(3) of the Minimum Standards of the Architectural
Education Regulations 2020.

The following is the chronological arrangement of events that transpired


preceding the filing of this Writ Petition.

DATE EVENT

11.08.2020 The Architectural Education Regulations, 2020 was published


in the Gazette of India to come into force from 01.11.2020.

03.03.2021 The Petitioner is an architectural engineering aspirant who


completed her 12th grade with 83% marks and wished to sit for
the National Aptitude Test in Architecture (NATA).
NATA 2021 brochure was released announcing that NATA for
the academic year 2021-2022 will be held twice this year and
that students can attempt both exams and the higher score will
be counted.

10.04.2021 Petitioner appeared for both the exams and scored 65 and 62
& respectively.
12.06.2021 The Architecture Council reduced the qualifying marks from 75
to 70 even though the same is inconsistent with the Act or the
regulation under the act.

03.09.2021 Petitioner intended to appear for a third time for the test.

24.07.2021 Third Respondent issued circular and clarified that candidates


should be allowed to appear for NATA 21-22 only for a
maximum of two times and shall not be eligible for a third
attempt.

28.07.2021 Petitioner made a common representation as against the said


regulation which was met with no response.

27.07.2021 Aggrieved by the same, the Petitioner has filed this Writ
Petition.
