DEED OF EXTRA-JUDICIAL SETTLEMENT OF REAL PROPERTY

WITH WAIVER AND RENUNCIATION OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

WHEREAS, AURORA CASTRO LAYUG., died intestate at Phase 10-A


Package 2 Block 1-B Lot 4, Bagong silang, Caloocan City on 13 April 2018, leaving no
will nor debts settled to date but leaving a parcel of land;

WHEREAS, at the time of her death, she left as forced heirs, the following and
to wit:

ROSEMARIE LAYUG CENTENO of legal age, Filipino, married,


and with residence and postal address at Block 20 Lot 21 Karisma Vill,
Panghulo, Malabon City;

JIMMER CASTRO LAYUG, of legal age, Filipino, single, and with


residence and postal address at Phase 10-A Package 2 Block 1-B Lot 4, Bagong
Silang, Caloocan city;

NOVA LAYUG LOPEZ, of legal age, Filipino, married, and with


residence and postal address at 116-C Sisa st. Acacia, Malabon City ;

MENCHIE CASTRO LAYUG of legal age, Filipino, single, and with


residence and postal address at Phase 10-A Package 2 Block 1-B Lot 4, Bagong
Silang, Caloocan city;

JOHNNY CASTRO LAYUG, of legal age, Filipino, and with


residence and postal address at Block 10 Lot 25 Karisma Vill Panghulo,
Malabon City;

MERLINA LAYUG DELOS SANTOS, of legal age, Filipino, married


and with residence and postal address at Phase 10-A Package 2 Block 1-B Lot
4, Bagong Silang, Caloocan city

WITNESSETH:

THAT we are the legitimate children respectively, of AURORA CASTRO


LAYUG, who died on 13 April 2018 in Caloocan City; copy of her death certificate is
hereto attached as Annex “A” and OSCAR MONTEMAYOR LAYUG, who died on
11 January 1980 in Manila, copy of his Death Certificate is hereto attached as Annex
B;

THAT said deceased died without any will or testament and without any
outstanding debts in favor of any person or entity;

THAT said deceased, at the time of her death left a certain real property,
situated in Caloocan City and more particularly described as follows, to wit:

A parcel of land (Lot 4 Block 1-B of the subdivision plan, Psd-


13-003956, being a portion of Block 87, Psd-13-003721, LRC
Record No. ) , situated in the Barrio of Bagong Silang (Tala)
Mun. of Caloocan, Metro Manila, Bounded on the North along
line 1-2 by Lot 3, Block 1-B, on the west along line 2-3 by Block
66, on the south along line 3-1 by Lot 5, Block 1-B, and on the
west along line 4-1 by road Lot 2(6.00 m. wide) all of the
subdivision plan, Beginning at a point marked l on plan being N.
42 deg. 07 W., 1519.54 m. from Mon.117, Tala Estate; thence
due East8.58 m. to point 2; thence S.00 deg. 24. E., 12.00 m to
point 3; thence Due West 8.67 m. to point 4; thence Due North
12.00 m to point of beginning; containing an area of ONE
HUNDRED THREE SQ. METERS & FIFTY (103.50) SQ.
DECIMETERS. All points referred to are indicated on the plan
and are marked on the ground by P.S. Cyl. Conc. Mond. 15x40
cm. bearing true ; date of the original survey, during 1907 and
that of the subdivision survey , March 23 – May 30, 1987.
Approved on aug. 12, 1987.

WHEREAS, in view of the above facts and circumstances, we are therefore co-
owners and to terminate co-ownership over the same, we hereby adjudicate over the
same in pro-indiviso sharing pursuant to Section 1, Rule 74 of the Rules of Court of
the Philippines, subject to the liabilities imposed by Section 4, of the same rule.

WAIVER OF RIGHTS

WHEREAS, We, ROSEMARIE LAYUG CENTENO, JIMMER CASTRO


LAYUG, NOVA LAYUG LOPEZ, MENCHIE CASTRO LAYUG and JOHNNY
CASTRO LAYUG (whose personal circumstances is mentioned above) has agreed

and covenanted to CEDE, TRANSFER and CONVEY unto our co-heir MERLINA
LAYUG DELOS SANTOS(whose personal circumstances are mentioned above),
their heirs and assigns the full ownership and possession of the above-described
property.

NOW, THEREFORE, for and in consideration of the foregoing premises, We


waived and renounced as by these presents, We hereby WAIVE and RENOUNCE our
share, right and participation over the above-described property in favor of
MERLINA LAYUG DELOS SANTOS their heirs and assigns the full ownership
and possession of the above-described property.
