THE FACTORIES ACT, 1948
THE FACTORIES ACT, 1948
• Act which makes it obligatory on the part of
the employer to provide for the health, safety
and welfare of the workers employed.
• Act extends to the whole of India.
• Applies to every factory wherein 10 or more
workers are or were employed, if run with
power and 20 or more workers are or were
employed, if run without power.
Working Hours, Spread Over & Overtime of Adults
Hours of work (adult) not to exceed 48 hours in a week or 9 hours in a day.
Payment of Overtime wages for overstay at workplace @ twice the ordinary rate of
wages (Gross Sal).
Weekly Holiday: One day of rest should be provided in a week.
Intervals of rest: half an hour for 5 hours of work.
Spread over not more than 10½ hours.
Overlapping shifts prohibited.
No child (who has not attained the age of 14 years) be permitted to work.
Prohibition of employment of Women( except with prior exemption): No woman
shall be employed in any factory for more than 9 hours in any day or between 7 pm
and 6 am.
Employer to keep the Factory premises clean
White washing at least once in every 14 months
Repainting or revarnishing in every 5 years
Ensure proper disposal of wastes and effluents
Record the dates on which white washing, painting or varnishing done in a register
(Prescribed by the State Govt.)

Ensure spittoons are provided at adequate places.
Ensure workplace has adequate ventilation
Avoid overcrowding – ensure 500 cubic feet of space for every worker without
reference to any space which is more than 14 feet above the level of the floor of the
room.
Ensure proper lighting- artificial or natural or both.
Ensure supply of uninterrupted supply of Drinking Water.
Where the no. of workers is more than 250, provision for cold water shall be
ensured.
Employer to ensure the Safety of workers
Fencing of Machines and Moving parts of machines – spindles, gears, pulleys, belts
etc
Protection of eyes using screens or goggles.
Precaution in case of Fire.
No woman or young person shall, unaided by another person, lift, carry or move by
hand or head any material or tool exceeding the maximum limit prescribed in the Act.
Employment prohibition of young persons on dangerous machines.
Striking gear and devices for cutting off power.
Prohibition of employment of women near cotton-openers.
Safety Officer: Appoint a Safety Officer wherein 1000 or more workers are
employed.
Employer to ensure the welfare of workers
Washing facility separately for women and men

THE INDUSTRIAL EMPLOYMENT
(STANDING ORDER) ACT, 1946

• Defines the terms and conditions of service between the employer and his
employees.
• Applies to every industrial establishment wherein 100 (in some States 50)or
more workers are employed
• The Act extends to the whole of India
SIGNIFICANCE

• Terms of appointment order issued to an employee cannot circumvent the


provisions of certified standing order.

• Therefore, it is always desirable to get standing orders drafted and certified


as it regulates the relationship between the employer and the employee.
Matters to be provided in Standing orders
Classification of workmen, e.g., whether permanent, temporary, apprentices, probationers, or badlis.

Manner of intimating to workmen periods and hours of work, holidays, pay-days and wage rates.

Shift working.

Attendance and late coming.

Conditions of, procedure in applying for, and the authority which may grant, leave and holidays.

Requirement to enter premises by certain gates, and liability to search.

Closing and re-opening of sections of the industrial establishments, and temporary stoppages of work and the right
and liabilities of the employer and workmen arising therefore.

Termination of employment, and the notice thereof to be given by employer and workmen.

Suspension or dismissal for misconduct, and acts or omissions which constitute misconduct.

Means of redressal for workmen against unfair treatment or wrongful exactions by the employer or his agents or
servants.

Additional Matters
Service Record – Matters relating to service card, token tickets, certification of service, change of residential address of

Submissions of Draft Standing Orders

Within six months from the date when the Act becomes applicable to an industrial establishment.
Five copies of the draft Standing Orders are to be submitted to the Certifying Officer under the Act.

Procedure for Certification of Standing Orders

Certifying Officer to forward a copy of draft standing orders to the trade union or in the absence of
union, to the workmen of the industry. The trade union or the other representatives, as the case may
be, are to be heard.
Payment of Subsistence Allowance to the
Suspended Workers
At the rate of fifty per cent, of the wages which the workman was entitled to immediately proceeding
the date of such suspension, for the first ninety days of suspension.
At the rate of seventy-five percent of such wages for the remaining period of suspension if the delay
in the completion of disciplinary proceedings against such workman is not directly attributable to the
conduct such workman.

Procedure for Certification of Standing Orders

Certifying Officer to forward a copy of draft standing orders to the trade union or in the absence of
union, to the workmen of the industry. The trade union or the other representatives, as the case may
be, are to be heard.
PENALTY

•Failure of employer to submit draft Standing Orders fine of Rs.5000 and Rs.200 for every day on continuation

•Two nursing breaks in the course of her daily work until the child is 15 months old.
•No discharge or dismissal while she is on maternity leave.
•No change to her disadvantage in any of the conditions of her employment while on maternity leave.
•Pregnant women discharged or dismissed may still claim maternity benefit from the employer.

Exception : Women dismissed for gross misconduct lose their right under the Act for Maternity Benefit

Forfeiture of maternity benefit

If a woman works in any establishment after she has been permitted by her employer to absent
herself under the provisions of section 6 for any period during such authorized absence, she shall
forfeit her claim to the maternity benefit for such period.
For discharging or dismissing such a woman during or on account of her absence from work, the
employer shall be punishable with imprisonment which shall not be less than 3 months, but it will
extend to one year and will find, but not exceeding Rs.5,000. Sec. 18

The Cabinet in its meeting held on October 1, 2007 has approved the Amendments to the payment of Bonus Act, 1965,
which are as follows (wef 01.04.06):-

i) Amendment to Section 2(13): To raise the eligibility limit for payment of bonus from the salary or wage of Rs.3500/- to
Rs.10,000 per month.

ii) Amendment to section 12: To raise the ceiling for calculation purpose from the salary or wage of Rs.2500/- to
Rs.3500/- per month, and;

iii) Deletion of section 32(vi): To cover the employees employed through contractors on building operations .

Amendments :

Section 2(n) excludes people who are employed in a casual nature and those who are employed 'otherwise than for the purpose of
the employers trade or business. This exclusion is sought to be removed.

Section 4 sets the minimum amount payable for death and permanent total disablement as Rs 50,000 and Rs 60,000 respectively.
These are sought to be enhanced to Rs 80,000 and Rs 90,000 respectively.
Explanation to Section 4 set a ceiling of Rs 2000 for the purpose of calculating wages. This ceiling is sought to be enhanced to Rs
4000.
Section 4(4) requires the employer to deposit Rs 1000 with the commissioner as funeral expenses payable to the workman. This
amount is sought to be increased to Rs 2,500.
Section 4(A) specifies that the penalty on late payments is to be credited to the State Government. It is sought to credit the penalty
