1. On February 15, 2023, accused pleaded guilty to the lesser offense of simple theft and
was sentenced to suffer an indeterminate penalty of Four (4) months of arresto mayor
medium, as minimum, to two (2) years and four (4) months of prision correccional
minimum as, maximum.
2. The offense for which accused was convicted is not a crime against the Security of the
State and Public Order;
3. The accused does not suffer from any of the disqualifications of the Probation Law and
he would like to avail of the benefits and privileges accorded by law to first time
offenders;
4. The accused has not been previously placed on probation under the provisions of P.D.
968, as amended by R.A. 10707;
5. The accused is sincerely remorseful of having committed the offense and if granted
probation, he is willing to undergo supervision under such terms and conditions that
may be imposed by the Honorable Court.
PRAYER
Other reliefs which may be just and equitable under the premises are likewise prayed for.
