on this 05th day of October. 2018 between Smt. Gita wife of Shri Sunil Kumar r/o H.NO. E-36, A, E – Block, Uttam Nagar, West Delhi -110059 (hereinafter called the landlord /owner/ first party) AND Ms. Sakshi Gambhir D/O Shri Rajesh Gambhir R/O D-99, Pushpanjli Enclave, Pittam Pura, Delhi, aged about 30 years, (hereinafter called the Tenant/ SECOND PARTY). The expression of landlord/ owner/first party and tenant/second party shall mean and include the parties, their respective heirs, successors, legal representatives, administrators, executors and assignees etc.
WHEREAS the landlord/ first party is the owner
of property NO. E-36, A, E – Block, Uttam Nagar, West Delhi -110059 and the second party is desirous/requested to take one room and kaitchen alongwith latrine and bath room of the above said property without roof rights on rent for a period of ll months starting w.e.f.1.10.2018 to 30.9.2019 at a monthly rent of Rs.12,000/- (Rupees Twelve thousand only). The first party has agreed to let out the same at the above said rate of rent to the second party for eleven months on the following terms and conditions:-
NOW THIS RENT AGREEMENT WITNESSETH AS UNDER:-
1. That the tenancy shall commenced
w.e.f.1.10.2018 and ends on 30.9.2019 i.e. the same shall be for the period of 11 months and the possession of the tenanted premises has been handed over to the second party on l.l0.2018 and the agreement reduced into writing today. And the tenancy month starts from 1st day of each English calander month and end on the last day of the same month.
2. That the monthly rent of the tenanted premises
is fixed between the parties at Rs.12,000/- (Rupees Twelve thousand only) per month in advance on or before 5th day of each English calander month excluding electricity and water charges. The electricity shall be paid at the rate of Rs.10/- per unit as per consumption shown by the sub meter and water charges shall be paid at the rate of Rs.200/- per month to the first party by the second party.
3. That the tenant shall use the tenanted
premises for residential purposes.
4. That the tenant cannot make any permanent
structural additions or alterations in the tenanted property without the consent of the landlord/ first party. 5. That the tenant shall not keep any inflammable and explosive things in the property in any manner and the tenant himself shall be responsible for any mis-deed, mis-behavior, injury, accident, fire accident etc.
6. That the tenant shall not sublet, assign,
transfer and/or part with the possession of the tenanted premises without the written consent in writing from the landlord.
7. That the tenant/second party undertakes not be
use this agreement to borrow any sum of money from any bank, financial institution.
8. That both the parties and their legal heirs
shall be bound by the term and condition of this agreement during the tenancy period for in future.
9. That the second party shall obey the laws,
rules and regulations of MCD, BSES/NDPL , Delhi Govt. or any other concerned authorities of Delhi Govt. or Central Govt.
10. That the second party shall vacate and
handover the vacant and peaceful possession of the tenanted premises after the expiry ll months in writing to the first party in original condition. In case the second party fails to vacate and handover the tenanted period on or before 30.9.2019 then the second party shall pay Rs.300/- per day as use and occupation/damages /penalty with interest.
11. That the second party shall serve one month
notice in advance for vacating the premises prior to the expiry of ll months or in lieu thereof shall pay one month rent to the first party and in case the first party desires to get the premises vacated from the second party then the first party will serve one month notice upon the second party.
12. That the first party or her authorized Person
or family members shall have right to inspect the tenanted premises at reasonable hours and also to collect the rent on the instruction of the first party. 13. That the copy of this agreement has been handed over to the second party and the original agreement remains with the first party.
14. That the second party shall maintain the
premises and always keep the same in good habitable conditions and not damage and caused to be damaged the premises under the tenancy. 15. That in case the second party wants to remain in possession of the tenanted premises as a tenant after the expiry of 11 months, then fresh rent agreement would be executed by increasing l5% rent. The extension of tenancy period shall be at the will of the first party. IN WITNESS WHEREOF the parties have signed this agreement on the day, month and year first above written. WITNESSES: 1.
