Why Have An EAIR?


• If working towards ISO 14001:2015 EMS, it is a necessity.

• The key success factor of implementing ISO 14001:2015 EMS is to understand


environmental aspects and impacts:

 The waste that listed in the First Schedule of Environmental Quality (Scheduled
Wastes) Regulations 2005.
 In general terms, a waste that listed in the schedule is classified as a toxic or
hazardous waste with properties that make it dangerous or potentially harmful to
human health or the environment.

34B. Prohibition against placing, deposit, etc. of scheduled wastes.

(1) No person shall --


(a) place, deposit or dispose of, or cause or permit to place, deposit or dispose of,
except at prescribed premises only, any scheduled wastes on land or into
Malaysian waters;
without any prior written approval of the Director General.

(2) The Director General may grant the written approval either subject to conditions
or unconditionally.

(4) Any person who contravenes this section shall be guilty of an offence and shall
on conviction be punished with imprisonment for a term not exceeding five years
and shall also be liable to a fine not exceeding five hundred thousand ringgit.

Regulation 3 – Notification
Every waste generator shall notify within 30 days from the date of generation of
scheduled wastes

Regulation 8 – Responsibility
 Scheduled wastes shall be stored, treated, recovered in a proper manner
 Scheduled wastes shall be packaged, labelled and transported in accordance with
prescribed guidelines
 Scheduled wastes shall be delivered and received safely at prescribed premises
for treatment, disposal or recovery

Regulation 9 – Storage
Store for not more than 180 days and/or accumulated quantity not more than 20
metric tons

Regulation 16 – Compounding of Offences


Every offence is liable to be compounded not exceeding RM2,000

1. Container containing waste should always be closed at all time.


2. Container is free of leakage, hole, dent, bulge or corrosion.
3. If a container is in leaking, the spillage should be contained immediately,
prevented from spreading and transferred to a new container.
4. Drums should be stored vertically and not horizontally.
5. Suitable equipment such as forklift to move the container. Container should not be
pushed, rolled or dragged.
6. Ample aisle space is provided for free movement of forklift, emergency fire
fighting purpose, emergency escape route and ease of inspection.
7. Smoking should be prohibited in the storage area.
