The right to health is of vital importance for all people, it cannot be denied either
because of their socio-economic background, religion, or culture. Because this implies
the real guarantee to enjoy a physical, mental, emotional and social state that allows
human beings to develop their potentialities in a dignified manner and to the maximum,
for the good of themselves, their family and the community in general, The right to
health is developed in innumerable provisions of legal and regulatory origin. Especially
through Laws 100 of 1993, 1122 of 2007 and 1438 of 2011. Let's define a little what is
the right to health, The World Health Organization defines the right to health as "a state
of complete physical, mental and social well-being" and not merely the absence of
disease or infirmity. States must ensure both freedoms and rights. This includes the
right to control one's health and body, including sexual and reproductive freedom, and
freedom from interference such as torture, non-consensual medical treatment and
experimentation. The rights include access to adequate health facilities and services, as
well as appropriate State measures in relation to socioeconomic determinants of health,
such as food, water and sanitation, safe and healthy working conditions, housing and
poverty. And as it says in the work article, that the right to health, without a doubt, is a
fundamental right; and as a seriously fundamental right, it must be subject to each and
every one of the constitutional and legal guarantees provided for such types of rights
and not only for the purposes of its justiciability via tutela action. This refers both to the
right of people to obtain a certain level of healthcare and health, and to the obligation of
the State to guarantee a certain level of public health with the community in general.
