MOTION TO DEFER ARAIGNMENT AND SUSPEND PROCEEDINGS

PRIVATE COMPLAINANT, AAA, by and through the undersigned

counsel, most respectfully files this instant motion, and allege as follow:

1. The arraignment of the accused in this case was set on 24 March 2020
at 8:30 in the morning;
2. That on 22 January 2020, the private complainant filed before the
Department of Justice a Petition for Review vis-a-vis the Manifestation
of the Provincial Prosecutor submitted before this Honorable Court;
3. That under Sec. 11 (c) of the Revised Rules on Criminal Procedure,
arraignment shall be suspended when a petition for review of the
resolution of the prosecutor is pending at the Department of Justice;
4. Thus, it is with full respect prayed before the Honorable Court
that the arraignment of the accused be deferred pending the
Resolution of the Department of Justice..

WHEREFORE, it is respectfully prayed that the arraignment of the

accused be deferred and proceedings be suspended. Other relief just and
equitable are likewise prayed for.
