COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement is being executed this 14th day of November 2022, by and
between:

ROWENA A. DIMLA, of legal age, filipino, married with address at


Wellington Residence Brgy. Tres Cruses Tanza Cavite hereinafter referred to as the
“FIRST PARTY”;
-and-

RAZEL ANN BRIONES y REYES, of legal age, filipino, married with address
at Brgy. Baclaran Paranaque City hereinafter referred to as the “SECOND PARTY”;;

WITNESSETH:

WHEREAS, the FIRST PARTY is the private complainant in People of the


Philippines vs. Razel Ann Briones y Reyes, under criminal case nos: TMCR-1086-22 for
LIBEL UNDER SEC. 4 (c) 4 of R.A 10175 under RTC Branch 130 in Trece Martires
Cavite, while the SECOND PARTY is the accused;

WHEREAS, both PARTIES desire to put an end to litigation of the above


mentioned cases;

NOW THEREFORE, the PARTIES, assisted by the assigned mediator herein,


upon signing of this Agreement, hereby undertake and mutually agree as follows:

1. The SECOND PARTY shall pay the FIRST PARTY the amount of THIRTY
FIVE THOUSAND PESOS ONLY (PhP 35,000.00) in CASH in order to settle
the civil and criminal aspect of the case against her, payable for FIVE (5)
MONTHS with Monthly payment of SEVEN THOUSAND PESOS (Php
7,000.00) Starting December 15, 2022 to April 15, 2022.

2. The SECOND PARTY shall have be obligated also to extend her apology
through Social Media (Facebook) favor with the Complainant and all those
person that has been affected by these issues at hand. This condition shall be
effective after signing of this agreement, and the SECOND PARTY shall

present a printed screenshot of her own posted apology statement, favor
with the complainant.

3. Each Party hereby severally represents and warrants that this Agreement
has been duly executed, and delivered by each Party and constitutes that it
is legal, valid, and binding obligation, enforceable against them in
accordance with its terms. Each Party has voluntarily executed this
Agreement with the assistance of the assigned mediator of Philippine
Mediation Center Trece Martires Cavite and with full knowledge and
understanding of the terms and conditions thereof and its legal
consequential effects.

4. Incase, the SECOND PARTY fails to pay on a designated due date after Five
Days, this Compromise Agreement shall be declared Null and void and the
FIRST PARTY shall have the right to file a MOTION TO REVIVE THE
CASE, before this honorable jurisdiction.

5. Upon (i) execution of this Agreement and (ii) payment of the full amount in
cash to FIRST PARTY as agreed upon in paragraph 1 hereof, FIRST PARTY
shall execute an Affidavit of Desistance for the dismissal of the
above-mentioned cases and the Affidavit of Desistance shall be immediately
filed with the Regional Trial Court Branch 130 of Trece Martires Cavite for
the latter’s order and immediate dismissal of the above-entitled case.

6. The PARTIES hereby mutually, freely and voluntarily release one another,
from any and all manner of action and causes of action whatsoever in law or
equity, which they had, now have, or may have against each other arising
from the same incident and causes of action.

IN WITNESS WHEREOF, the parties have mutually agreed to the above stated
stipulations and sign this Compromise Agreement this 14th day of November 2022.
