VI. Question
1. What is the difference between a cosmetics and an OTC-drug cosmetics?
- Cosmetics are defined by the U.S. Food and Drug Administration (FDA) as "articles
intended to be rubbed, poured, sprinkled, or sprayed on, introduced into, or otherwise
applied to the human body...for cleansing, beautifying, promoting attractiveness, or
altering the appearance." Examples of cosmetics include lipsticks, nail polishes, and
perfumes. OTC drug cosmetics, on the other hand, are cosmetic products that also have
a medicinal or therapeutic purpose. Examples of OTC drug cosmetics include anti-
dandruff shampoos and sunscreens.

2. What is the role of FDA in the regulation of cosmetics and personal care products?
- The FDA is responsible for ensuring that these products are safe for use, properly
labeled, and free from false or misleading claims. The FDA regulates cosmetics under
the Federal Food, Drug, and Cosmetic Act (FD&C Act) and the Fair Packaging and
Labeling Act (FPLA). The FD&C Act requires that cosmetics be safe for use and
properly labeled, while the FPLA requires that cosmetics be packaged and labeled in a
way that is truthful and not misleading. The FDA also has the authority to take
enforcement action against companies that violate the FD&C Act or FPLA, including
recalling products, seizing products, and taking legal action against companies that
violate the law.
- In the Philippines, the regulatory agency responsible for overseeing the safety and
quality of cosmetics and personal care products is the Food and Drug Administration
(FDA) Philippines. The FDA Philippines is responsible for ensuring that cosmetics and
personal care products sold in the Philippines are safe for use and properly labeled, and
has the authority to take enforcement action against companies that violate the
regulations.
