Application for exemption of the personal appearance of the accused,

Manoj Kumar Das for today only.

RESPECTFULLY SHOWETH:

1. That the petitioner is a law abiding and peace loving citizen of

india.

2. That the above noted case is pending before this Hon’ble court

and is fixed for today.

3. That, the medical condition of the Petitioner is not well and

recently he has been diagnosed with Tuberculosis. Petitioner,

who is of about 50years of age, is already a patient of HIV

Positive, High Blood Sugar and acute anal fissure (Piles/

Haemorrhoids). The Petitioner had also suffered from bleeding

from rectum from December, 2019 till 30.04.2020, while he was

in Jail as per the report of the Dy. Jail Superintendent, Tihar Jail,

Delhi. So he is unable to attend this Hon’ble court today.

4. That vide order dated 12.08.2021 The Hon’ble Supreme Court

has given time for surrendering to the abovenamed accused till

09.09.2021 true copy of the Order dated 12.08.2021 passed ..by

 this Hon’ble Court in the instant SLP(Criminal) No.3243/2021 is

attached herewith as Annexure P1.

5. That the absence of the accused is not intentional but due to the

aforesaid bonafide reason.

PRAYER: In view of the above, it is most respectfully prayed that

this Hon’ble Court may graciously be pleased to:

a) Allow the instant Application, It is therefore, most respectfully

prayed that the personal appearance of the above named

accused may kindly be exempted for today.

b) pass any other order or orders as this Hon’ble Court may

deem fit and proper in the interest of Justice.

AND FOR WHICH ACT OF KINDNESS THE PETITIONER

RESPECTFULLY SHOWETH:

1. That the petitioner is a law abiding and peace loving citizen of

india.
2. That the above noted case is pending before this Hon’ble court
and is fixed for today.
3. That, this Hon’ble court has issued NBWs against the accused
vide Order dated- .
4. That, the medical condition of the Petitioner is not well and
recently he has been diagnosed with Tuberculosis. Petitioner,
who is of about 50years of age, is already a patient of HIV
Positive, High Blood Sugar and acute anal fissure (Piles/
Haemorrhoids). The Petitioner had also suffered from bleeding

5. That vide order dated 12.08.2021 The Hon’ble Supreme Court
has given protection to the accused for surrendering to the
abovenamed accused till 09.09.2021 true copy of the Order
dated 12.08.2021 passed ..by this Hon’ble Court in the instant
 SLP(Criminal) No.3243/2021 is attached herewith as Annexure
P1.
6. That on the above mentioned medical ground and Looking at the
protection granted by supreme court the NBWs issued by this
Hon’ble court is liable to the cancelled.
7. It is, therefore, most respectfully prayed that NBWs issued by
this Hon’ble court vide order dated- is be cancelled.
8. PRAYER: In view of the above, it is most respectfully prayed that
this Hon’ble Court may graciously be pleased to:

a) Allow the instant Application, and most respectfully prayed that

the NBWs issued by this Hon’ble court vide order dated-
is be cancelled.

b) pass any other order or orders as this Hon’ble Court may deem
fit and proper in the interest of Justice.
