Midterm Assignment
Due on March 20, 2023

QUESTION / SHORT ESSAY, 45 points

Discuss ANY ONE of the two essay questions below with explanations using any
citation system. You are not required to submit a bibliography.

Question 1.

Different positive and natural law theories have implications for obligation in
understanding the law. Examine what account/s of legal theory/theories, as
discussed in class, appeal to you as they relate to obligation in contemporary
jurisprudence or law. Do considerations such as moral, social, political, historical,
and other contexts have implications for obligation in understanding law? You may
draw upon the various examples/issues as appropriate in your discussion. (4-5
pages)

OR

Question 2.

a) Draft a hypothetical situation illustrating the juxtaposed theories of positive and


natural law. The narrative of the illustration should be original. (2-2.5 pages)

b) Discuss critically, as a judge, how you would respond to your hypothetical


situation. You may draw upon the theories and concepts discussed in class and
as appropriate and relevant to your response argument/s. (2-2.5 pages)

GENERAL INSTRUCTIONS

Points: The assignment carries a total of 45 points. You are encouraged to reference
any coursework readings you rely on, and touching on extra research materials
beyond the coursework readings will be rewarded. The assessment also considers
how well the essays are crafted, including clarity of the position taken, use of
paragraphs to make distinct points, and balance between reliance on scholarly
material, analysis, and opinion. The assessment also follows the guidelines for
grading given in the course-manual outline, pages 8-9.
Format: The minimum length of the assignment is four pages, and the maximum is
five. Please type using the 12-size Times New Roman font in a double-spaced
format.

Submission Information: The deadline for submission is Monday, March 20, before
midnight through the Turnitin software. Late submission will incur a loss of points
@ 2/day.

Plagiarism: As the course manual states, the university has strict rules with
consequences for students involved in plagiarism. Please refer to the course manual
for the plagiarism policy. We will use software to check your essays for plagiarism;
this includes checking for external sources and papers of other classmates. The
penalties for plagiarism comprise a loss of points and a failing grade.
