2.0– Narrative and Facts
2.1- General Information
“M/V LEON DIAS” is a (OIL CHEMICAL TANKER) ship registered at Liberia with the
IMO number 9396385, currently is managed by the company LEON SHIPPING &
TRADING SA located at Athens – Greece, Registered Company IMO number:
5604684.
2.2- The incident
The Vessel M/T LEON DIAS receives voyage instructions 20/Nov/2018 at 12:09 LT
to load 95,000 bbls of Jet Fuel at the “El Palito” - Venezuela Terminal to deliver to
CUBAMETALES – Cuba, with L/C 19-21/Nov/2018.
The vessel arrived at “El Palito” on 17/Nov/2018 at 05:00 LT and commenced
loading on 19/11 at 17:50 LT, as per Master’s pre-stow plan, the above cargo should
be accommodated in cargo tanks No.2 P+S and No.3 P+S.
On 20/Nov/2018 The Charterers send message to the Master as follows:

As mentioned before, chrtrs intention is to load an additional 2400 m3 Jet Fuel (quality under revision)
fully segregated from loaded parcels (Line displacement / Nominated cargo).
After look through your previous stowage plan, we assume it can be loaded in 1W if stability

In addition to my previous msg pls find attached Stowage plan with 3 parcels of JET FUEL and
cargo of GASOIL tt to be loaded in Punta Cardon.

Forthcoming loading Jet A1 needs no instructions due to is under nominated 94.000 bbls. Chrtrs
confirm no tank cleaning required for 15.000 Bbls to be loaded into Cot 1P.

According to the attached SOF the Master reports the following:

20/11 08:40 LT – Loading COT 2W+3W suspended by terminal request. Cargo o/b is 64 710 bbls
20/11 14:50 LT – Resumed loading COT 2W+3W (See attached SOF)
On 14:50 LT Loading Master call vsl by VHF and inform to continue loading an open ship’s manifold,
But nobody not inform the vessel that cargo, currently loaded designated for COT 1P.
Before completion of loading on 21:25 LT Cargo Surveyor come back to vsl and inform Chief Officer
that parcel #3 (15000 bbls) already loaded.
Upon realizing that the cargo resumed by the terminal is the 15,000 bbls mentioned
in the travel instructions (due to nobody from Terminal informed to the vessel that
the cargo which currently loaded was designated for COT 1P), the Master
immediately informs the Charterers that the cargo segregated for the COT 1P Tank
had been mixed in cargo tanks COT 2P, 2S, 3P and 3S.
In spite of the explanation and notification of the mixture of cargo destined for COT
1P, the Charterers instructed the Master to sign the B / L.
At the end of the loading operations, the product quality documents were received,
as well as the samples of the shore tanks, despite having taken samples in the tanks
of the ship, the Master never received the Product Quality Certificates from terminal.

2.3- Ship and cargo Situation
At the time of the inspection, the ship was at the pier of the terminal of the Cardon
Refinery connected to start loading the remaining tanks. See the Annex Cargo Plan.
3.0– Visual Survey Findings

The Inspector next to the Captain checked the cargo manifold (Port and Starboard)
lines, valves and tank caps of the vessel, the respective samples were taken from
the COT cargo tanks W2, W3 and Slop S.

4.0) Comments & Remarks
The ship M/T LEON DIAS, is operating without observations or non-

compliance, the maintenance is evident, so that any equipment defect is
ruled out if the load goes out of specification.
he inspection was attended by Captain Oleg Kapara, who explained

clearly how the events occurred and showed the attached evidence of
the loading process at El Palito Terminal.

5.0) Conclusions
In view of all the evidence collected and annexed in this investigation, the
VENEPANDI, C.A.´s Surveyor who subscribes concludes the following:
a) he poor communication of the terminal personnel in charge of the loading

operations (Loading Master), the ignorance of the English language and the
lack of presence on board, caused that at the time of resumption of the cargo
the ship was not notified responsibly and in time. to make the respective
alignments to load the COT 1P as it was raised, so when resuming it was only
requested to open the manifold and mix the load in the COT W2 and W3.
b) Sudden changes of instructions prior to and during loading operations,
generated situations of change of cargo plans that affect the ship's operations
As consequence of the incident no people was injured and no environment

affectation.
Our appointment and attendance were centered in P & I matter.
This report was issue in good faith without prejudice, printed in Caracas on
November 28, 2018
