People vs.

Santiago

Facts: An information for the crime of libel was charged against Isauro Santiago for injuring the name and reputation of
Arsenio H. Lacson in the course of a political speech thru the medium of an amplifier system and before a crowd of
around a hundred persons.
Defendant moved to quash the information upon the ground that the crime charged is not libel but oral
defamation which has already prescribed. The Court of First Instance of Manila granted the motion and quashed the
information.

Issue: Whether or not the crime committed was oral defamation and not libel

Ruling: Yes. The Court held that radio as a means of publication is the transmission and reception of electromagnetic
waves without conducting wires intervening between transmitter and receiver. Transmission of words by means of an
amplifier system is not thru electromagnetic waves and is with the use of conducting wires intervening between the
transmitter and the receiver.
Pursuant to noscitur a sociae, the word radio used in Article 355 should be considered in relation to the terms
which it is associated which have a common characteristic, namely, their permanent nature as a means of publication.
