NOTICE OF APPOINTMENT TO POSITION OF HEAD MEN’S BASKETBALL COACH This Notice of Appointment (“Appointment”) confirms East Tennessee State University’s (University”) appointment of Brooks Savage (“Coach”) to the position of Head Men’s Basketball Coach at East Tennessee State University. University and Coach agree to execute a contract for employment consistent with the terms of this Appointment 1, The term of Appointment begins March 20, 2023 (“Effective Date”), and concludes March 31, 2028. 2. This Appointment comes with an annualized salary of $202,000 (“Base Pay”), which is payable in twelve monthly installments of 16,833.33, in accordance with University policies. For the period from the Effective Date through March 31, 2023, Coach will be paid a pro-rata portion of $16,833.33. Base Pay shall not be increased in accordance with the terms of any across the board or merit salary increase authorized or mandated for University employees by the State of Tennessee or the University Board of Trustees. Coach shall be a regular full-time employee entitled to all benefits of employment provided by University or the State of Tennessee. 3. University will provide Coach an annualized stipend of $38,000.00 for additional responsibilities set forth hereinbelow. The stipend will be payable monthly and divided into twelve monthly payments of $3,166.66. For the period from the Effective Date through March 31, 2023, Coach will be paid a pro-rata portion of $3,166.66. Coach must work with the Director of Intercollegiate Athletics or designee to establish community relations activities, which also include media interactions, on a yearly, monthly, and weekly basis that builds relationships with the varied constituencies ofthe Athletics Department and University to earn the annual stipend. This amount is not Base Pay. 4. Coach will receive either a vehicle stipend in the amount of $600.00 per month for the duration of the contract or a complimentary car. This amount is not Base Pay. The University provide a Country Club membership at Blackthorn Club commensurate with membership terms and conditions provided to other employees ofthe Athletics Department. This amount is not Base Pay. 5. Coach will provide University provide a one-time payment for moving expense: an estimate of moving expenses. University This amount is not Base Pay, 6. University may pay the following bonuses to Coach when the team has a winning, percentage of 50% or higher against Division I programs: + For each regular season win over an ACC, SEC, BIG 10, PAC 12, BIG 12, or Big East team $5,000 + Finish year with aNET of 51 to 100 $3,000 Finish year with a NET of 21 to 50 $5,000 + Finish year with a NET in the top 20 $10,000 Regardless of winning percentage against Division-I programs, University will pay the following bonuses to Coach: + One-time bonus for 20 wins vs Division 1 opponents $85,000 + For each win above 20 vs. Division I opponents $1,000 + Regular season conference championship $10,000 + Regular season shared conference championship $5,000 + For being named SOCON Coach of the Year $5,000 + For being named National Coach of the Year $10,000 + For NIT Appearanc $5,000 + For each NIT win $2,500 + NCAA Tournament Appearance $15,000, + For every win in NCAA Tournament $15,000 = NCAA National Championship $100,000 + NIT Championship $25,000, These bonuses are not part of Base Pay. University shall pay the bonus at the end of the fiscal year in which Coach earns the bonus. Subject to a win/loss record over .500 against Division-I programs, Coach is eligible for a bonus based on team’s academic progress rate (APR) performance as follows: (A.) APR greater than 980 $1,500.00; OR (B.) APR of 1000 $3,000.00 7. If.at any time during the term of this Appointment, Coach intends to resign from his employment with the University and accepts any employment at another college or university, Coach will notify the Director of Intercollegiate Athletics in writing and tender to University a buyout payment within 60 days of providing notice. The buyout payment will be equal to Coach's annual base pay as of the date of Coach's resignation. 8. ‘The University retains the right to terminate the Coach without cause as a result of University’s dissatisfaction with the Coach’s performance or for any reason that does not constitute termination for cause, subject to University’s obligation to pay Coach a Termination Payment. University will calculate and pay the Termination Payment as follows: + Termination before March 1, 2027 (One year’s base pay up to $300,000 - Termination after March 1, 2027 The remainder of base pay owed under the contract up to $300,000 University shall reduce the Termination Payment by the amount owed for any and all previously accrued personal leave. University shall pay Coach’s accrued leave in accordance with University policy. University shall pay the remaining balance of the ‘Termination Payment in equal monthly installments over a period of eighteen (18) months. IfCoach should secure employment in any capacity in college or professional athleties or in higher education administration at any time after termination, the University’s obligation shall be reduced by the amount of the salary earned by Coach in the new position. Coach shall notify the University of such employment within ten (10) business days of accepting employment. Benefits will cease upon notice termination or otherwise in accordance with University policy or state law. 9. University shall make the option of education at the University School available to Coach's children. Coach and Coach’s children must meet all University School application requirements, requests, deadlines, and policies during the admission process and enrollment period, 10. Inthe event that Coach does not have health insurance during the month of April from his previous employer, University will reimburse Coach for the COBRA premium for the month of April up to $3,000 upon submission by Coach of statement of the COBRA premium. 11. This Appointment is governed by the laws of the State of Tennessee, the policies and decisions of the Board of Trustees, and the policies of the University, all of which shall take precedence over the terms of this Appointment if any conflict exists. 12, Coach must signify Coach’s acceptance of the terms of this appointment by signing and returning this Appointment to the Office of the President. 13. Both parties agree that an electronic signature of a party, whether digital or encrypted, included in this Notice of Appointment is intended to authenticate this writing and to have the same force and effect as a manual signature. Delivery of a copy of this Notice of Appointment bearing an original or electronic signature by electronic mail in “portable document format” pdf”) form, or by any other electronic means intended to preserve the original graphic and pictorial appearance of a document, will have the same effect as physical delivery of the paper document bearing an original or electronic signature.
