(SECTION – A) (03X20)

1. (a) X, in order to ward off the flow of flood into his land from the connecting stream, dug
up a trench and constructed a bund on his land. As a result, water went to the Y’s
land and damaged his property. What remedy Y can claim under tort law?
(b) Distinction between tort and crime.
2. (a) X was engaged in leather tanning at Gomtinagar. During his work, as a result of the
process of degreasing pelts, small quantities of a solvent known as Perchoroethene
(PCE) was spilt on the floor of the X’s building. PCE eventually seeped through the
building floor and into the soil and contaminated the Y’s borehole which was
situated 2 miles away from the X’s building. Y was a company licensed to supply
water in that area. Because of X’s act, Y was not able to supply clean water. Y filed a
suit to claim compensation under strict liability.
In light of the above situation, discuss the liability of X, if any.
(b) A was driving negligently because of which accident took place and B’s husband and
children were injured. At the time of accident B was at home some 5 kms. away
from the accident scene and reached hospital after 2 hours of knowing the incident.
After seeing the serious injuries received by her family members she suffered a
nervous shock. Can an action be made against A for nervous shock? Support your
answer with relevant case laws.
3. (a) The plaintiff (A) was a passenger of defendant’s (B) bus with other passengers. The
bus was driven negligently and A fearing any accident jumped off the bus and got
injured. Fortunately, after few minutes the bus stopped and other passengers
were safe. A filed the suit for damages against B. Whether A is liable for any
compensation? Discuss.
(b) Write a note on contributory negligence.
4. In the light of Maharaja Agrasen Hospital and others. v. Rishabh Sharma and others
(2020) 6 SCC 501 discuss the development of medical negligence in India under tort law.
5. (a) Write a note on malicious prosecution.
(b) Relevancy of Knowledge in cases of false imprisonment.
6. (a) X wrote false letters to H (husband of W), in which he alleged that W was a witch and
had by her sorcery caused the death of some relations of X. He also wrote these letters
to the other relatives of H. H filed the suit for defamation. Will he succeed?
Support your answer.
(b) Discuss in detail the concept of Innuendo.

1. Examine the issues with defining abnormal behavior and discuss an alternate perspective

Note:
For Questions 5 and 6, on the basis of case briefs given make a diagnosis. Justify the
diagnosis that you have made discussing the symptoms involved. Elaborate upon the
complete clinical picture of the disorder. Briefly comment on the possible causes of
the psychological condition of the patient.
5. TS, a 25 years old female, presented with complaints of recurring images of her family
members meeting with an accident. The images are bloody and frightening for her. They
persist till she has prayed for the safety of her family several times. Over 3 months the
time spent on prayers has been increasing and also the frequency of violent images. Now,
she is unable to carry on her normal routines and spends over six hours praying every
day. She also feels that if she touches or even looks at any non-vegetarian food, her
family will be punished. She also asks her family members to pray before they leave the
house, even to go the park across the street. A week ago, the patient became convinced
the switching on a lamp in her room will increase the chance of her family members
meeting with an accident.
6. AQ is a 14 years old male. His parents brought him to a psychologist after he was
suspended from school because he beat a 9 year old student and broke his arm. The child
has a history of getting into fights and bullying other kids. He has snatched their
belongings and beat them when they complained. AQ also stole money from one
classmate after which he had to change schools. A week ago, he tried to burn the family's
pet dog and has previously set his sister's toys on fire after they fought. He answers rudely
when scolded and doesn't listen to any authority figures.

1. (a) The Indian Contract Act, 1872 was enacted to serve the interests of an imperial
power. Do you agree? Explain, giving reasons.
(b) Do public policy considerations limit freedom of contract? What, according to you,
should be included within the meaning of public policy?
2. (a) Solutions Ltd. has recently ordered fifty air conditioners from Air Breeze Pvt. Ltd.
Air Breeze agrees to supply and replies by speed post on its business letterhead
quoting the price of each unit of air conditioner and delivery date. On the backside of
the document there are a number of conditions in the fine print. One such condition
states that installation charges are to paid by the buyer. Solution Ltd. replies back on
its own business letterhead accepting the price and delivery date. The bottom of the
document provides that the contract is subject to standard terms printed at the back
which shall always prevail. One of the terms printed at the back provides that “supply
costs, installation charges, etc. are to be always borne by the supplier”. Later, Solution
Ltd. takes the delivery of air conditioners but is not ready to pay the installation
charges. Air Breeze seeks to recover the installation charges and has approached you
for legal advice. Write a legal advice for Air Breeze in view of the relevant legal
provisions and judicial precedents.
(b) Discuss, if the following clause in the employment contract, may be enforced against
the employee:
 Employee never to disclose any confidential information learnt during the course
of the employment even after leaving the employment.
3. (a) Can a standing offer result into a contract? Is it necessary to communicate the
acceptance of the contract always?
(b) Ms. Rakshanda lost her job during COVID-19. In the meanwhile, her brother
contracted COVID-19 and was admitted in ICU of a private hospital which were
demanding a huge sum of money every day to continue the treatment. Unable to get
loan from the bank, Ms. Rakshanda approaches a local business group for financial
help. The group agrees to lend around Rs. 25 lakhs on the condition that Ms.
Rakshanda transfers the ownership of her family home in their favor. The market
value of the family home is around Rs. 50 crores. However, Ms. Rakshanda and her
family members urgently require the money and so agree to do the same. Now, Ms.
Rakshanda wants to avoid the transaction and seeks to know if the agreement is
legally enforceable against her. Advise Ms. Rakshanda in view of the relevant legal
provisions and judicial precedents.
4. (a) Revitalize, a coffee shop had entered into a contract with a Mizoram based supplier
for supply of exotic coffee beans. However, on account of COVID-19, Revitalize has
lost considerable number of customers and does not require exotic coffee beans
anymore. Revitalize has sought your advice on whether it can avoid the contract under
section 56 of the Indian Contract Act, 1872. Write a detailed legal advice for
Revitalize.
(b) Do you think the language of the Indian Contract Act, 1872 is adequate to cover
communication of acceptance by telephones and emails? Explain, giving reasons.
5. Panache Pvt. Ltd, a company headquartered in Delhi, earns its revenue primarily from
exporting authentic Indian sarees to Europe. For this purpose, it has entered into a
contract with Fusions Pvt. Ltd, a Bhubaneswar headquartered company for supplying the
famous Sambalpuri Sarees to Panache. The contract between the two companies
stipulated that “products supplied must adhere to quality checks for Panache is an
internationally renowned company”. In the event of non-performance by Fusions, the
contract stipulated that Fusions would be “liable to pay the market price of the sarees to
be supplied and 50 percent compound interest calculated from the date of non-
performance”. Eventually, there is non -performance by Fusions in December, 2021 and
Panache claims that due to this it could not supply its international buyers and had to pay
them damages in Euro because of which it suffered huge losses as due to exchange rate
fluctuations in the month of December, the value of the Indian Rupee had declined
considerably anache claims that it is not only entitled to damages stipulated in the
contract but also that damages must be paid in Euros so as to take care of the exchange
rate fluctuations. Fusions approaches you for legal advice on whether the contractual
stipulation on damages is enforceable against them in view of the Indian law. And
whether, they are required to take the exchange rate fluctuations into account while
calculating damages. Prepare a detailed legal advice for Fusions.
6. Can minors enter into legally enforceable contracts in India? What are the remedies
available to the other party if the minor induces the other party to enter into the contract
by falsely representing their age?
