 How many leaves should a company provide under privilege and sick?

Sick Leave – 12 (During the first twelve months of continuous service)

Earned / Privileged Leave

- 18 (one day for every twenty days’ work)


- one day for every fifteen days of work performed by him, in case of a young person.1

 Other types of leaves?

Maternity leaves for female employees for any number of days not exceeding 12 weeks.

 When the employees stop working with the establishment, can these leaves be encashed?
- Section 15
 (4) If an employee is discharged or dismissed from service during the course of the year
he shall be entitled to leave with wages at the rates laid down in sub-section (1) even if he
has not worked for the entire period specified in sub-section (1) entitling him to earn
leave.
 (13) If the employment of an employee who is entitled to leave under sub-section (1) is
terminated by the employer before he has taken the entire leave to which he is entitled or
if having applied for and having not been granted such leave, the employee quits his
employment before he has taken the leave, the employer shall pay him the amount
payable under section 16 in respect of the leave not taken, and such payment shall
be made, where the employment of the employee is terminated by the employer,
before the expiry of the second working day after such termination, and where an
employee quits his employment, on or before the next pay day.

 Mandatory number of working days?

- 9 hours/ day and 48 hours/week. Total number of hours including overtime shall not exceed 10
hours in any day except on days of stock-taking and preparation of accounts.
- Total number of overtime hours worked by an employee does not exceed fifty in a period of three
continuous months.2
