Salient features of U.P.

Revenue Code, 2006


The main characteristics of the Code as under:

1) Repeal of 39 Acts(mentioned in Schedule 1) which were either unused or ineffective


and not applicable presently in the state.

2) Division of land in map and revenue-record showing "Minjumla


number"[Section 2 (29)]

3) Constitution of revenue Divisions and separate cadre of revenue officer (judicial) by


State Government.

4) Determination of maintenance of boundaries, settlement of boundary disputes


(sections 20 to 24), and right to recover the damages for destruction of
boundary-marks.

5) Mutation of names on basis of succession or transfer/will/gift (Sections 33 to 35)

6) Issuance of record of rights (Kisan Bahi(book)) to every tenure-holder by the revenue


officer (Section 41)

7) Protection of usufructuary and hereditary rights of persons who has planted trees on
Public land

8) Settlement of Abadi sites in favour of SC/ST/OBC whose house was existing on the
date of enforcement of U.P Revenue Code, 2006

9) The Non-transferable rights of Bhumidhar shall acquire Bhumidhar rights after 5


years (Section 76)

10) Every Bhumidhar has right to use of land and get the declaration for residential,
commercial or industrial purpose from competent authority (S.D.O.) (Section 80)

11) Person belonging to SC/ST. category has right to transfer the land in favour of non
SC/ST, his holding seeking prior Permission from collector

12) Protection of rights of unmarried daughters and third gender issues


(male/female) in Succession (Section 108, 109 and 110)

13) Murderer is disqualified from inheritance (Section 114)

14) Preference in favour of widow or physically disabled person at the time of grant of
agricultural lease by the Land Management committee (Section 126)
15) Eviction of Government lessee from land in case of failure to deposit of fees for more
than 6 months or in violation of terms and conditions of use of lease-land (Section
149)

16) No arrest of senior citizen or woman or minor or Armed Personal of union in service
for the recovery of land-revenue upto Rs. 50,000/- of (Section 171}

17) Power to transfer of pending cases by Board of Revenue/Commissioner/Collector/


Sub-Divisional officer (Section 212)

18) Determination of revenue disputes under summary Proceeding

19) Right to lodging of caveat before revenue court

20) Constitution of Village Panchayat Committee
