No. F 2016-04-03289 / Finance / Rules / Four:- By the State Government, Finance Department's Notification No. F-2016-04-03289, dated 11" May, 2022, the Old Pension Scheme has been restored in place of the New Contributory Pension Scheme for all the employees appointed on or after 1" November, 2004 in the pensionable establishment of the State Government, in exercise of the powers conferred by proviso in Article 309 of the Constitution of India, the Governor of Chhattisgarh, hereby, makes the following amendment in the said Notification dated 11" May, 2022, namely:~ AMENDMENT In the said Notification, - For serial number 5, 6 and 7, the following serial number shall be substituted, namely: “5(a) Option to remain in New Contribution Pension Scheme (NPS) to government servants appointed from 01-11-2004 to 31-03-2022 in the prescribed Form-I (Notarized) attached with the notification or the option to avail the old pension scheme will have to be submitted to the Head of Office in the prescribed Form-II (Notarized). The option once exercised by the Government servant shall be final and irrevocable, (b) Government servants appointed on 01-04-2022 and after that will compulsorily be members of the Old Pension Scheme. (©) The Pension Payment Order shall be issued to those Government servants/their nominees (in case of death) who have opted for Old Pension Scheme, who are eligible for pension under the provisions of the pension rules such as the Chhattisgarh Civil Services (Pension) Rules, 1976/Chhattisgath (Work-Charged and Contingency Paid Employees) Pension Rules, 1979 applicable to retired Government servants, only after depositing the government contribution deposited till the date of retirement/death and the amount of dividend earned thereon till the date of withdrawal, in the government account. The government servant will have to give consent for adjustment of the government contribution payable to the government and the amount of dividend eamed thereon from the amount of death-cum-retirement gratuity, leave encashment, group insurance scheme payable to the government servant, :(d) Due to non-receipt of amount deposited in NPS account from PFRDA, in the account of the State Government, in the cases of retirement or death of the government servants option for the Old Pension Scheme. the government servant will have to deposit the amount of government contribution deposited in their NPS account and the amount of dividend earned on the date of withdrawal, in the government fund. The amount deposited as above will be kept in a separate fund under the public account for the payment of future pensionary obligations and every year an amount equal to 4% of the pensionary obligation of the previous year will be invested in the pension fund 6. Government servants opting for Old Pension Scheme will be members of CGPF from 01-04-2022 and shall be govemed by General Provident Fund rules. Employee contribution deposited in the NPS account from 01-11- 2004 to 31-03-2022 and dividend earned thereon shall be payable to the government employee as per NPS rules. 7.
