Brief synopsis of commercial The plaintiff as developer and the dispute (not to exceed 5000 defendants as land owners entered words) into a MoU whereby it was agreed that the plaintiff will develop the land owned by the defendants. The plaintiff on the strength of such MoU commenced the task of developing a project namely ‘Swastik Elements’ upon the said property and incurred expense in connection with such development. However, on account of certain disputes by and between the parties, the aforementioned MoU was agreed to be cancelled subject to the defendants compensating the plaintiff for all the expenses as incurred by the plaintiff in developing the aforementioned project and for recording the terms of the conditional agreement for cancellation, the plaintiff and the defendants entered into a separate MoU. However, the defendants have grossly failed to make payment as per the later MoU and have instead proceeded with not only developing the project but in contravention to the terms of the later MoU are presently attempting to create third party right, title or interest in the project.
