Subject: Rampant Illegal Activities or Unsafe Practices


of LPG businesses in your locality

Dear

Good Day. I write on behalf of Liquefied Petroleum Gas Marketer’s Association


(“LPGMA”) Party-List. LPGMA is one of the major authors of Republic Act No. 11592,
otherwise known as LPG Industry Regulation Act. Also, LPGMA fully campaigns other energy
laws and DOE Circulars, for pursuing safety practices in selling and refilling LPG.

We would like to inform your good Office that LPGMA has received and continues to
receive reports about LPG Refilling Plants, LPG Dealers, and LPG Outlets operating in your
locality that willingly and intentionally commit the following Illegal Activities or Unsafe
Practices:

a. Operating Without the Required Permits and Licenses from DOE, Illegal Trading,
Underfilling, which violates B.P.33, as amended by P.D.1865, and R.A. 623, as amended
by R.A. 5700;

b. Refilling and Selling of branded LPG cylinders by unauthorized LPG Industry


Participant, which is considered Trademark Infringement and Unfair Competition under
R.A. 8293 or the Intellectual Property Code of the Philippines;

c. Among others, engaging in selling of LPG without the required Standard


Compliance Certificate from DOE, Sale or Distribution of LPG-filled Cylinders
without Seals, Tampered Seals, or Inappropriate Seals, Refilling LPG Cylinders
that have no required markings, considered substandard, and

Citing some examples, under R.A. 11592, if the LPG business is caught operating without the permits and licenses issued by
DOE, the owner of said business shall be liable in the amount of P5,000 for each day of operation without the required license . If
in case said business was caught illegally refilling a LPG cylinder, an administrative penalty of P25,000 per LPG Cylinder is
imposed.

with misleading information, and Overloading, which are all violations under DOE
Circular No. 2014-01-0001; and

d. Among others, Illegal Refilling, Underfilling, and Manufacturing, Distributing,


Refilling, or selling LPG cylinders carrying a trademark or trade name without the
express approval of the trademark owner, which are expressly prohibited under R.A.
11592.

These illegal activities or unsafe practices if continued in your city, will surely cause
unwarranted explosions or burning of properties and/or deaths, of your constituents.

To minimize, if not totally eradicate the above-mentioned illegal activities or unsafe


practices that greatly endanger the lives and properties of your constituents, we would like to
request your assistance in the revocation, non-renewal, suspension and/or non-issuance of
permits and/or licenses that these illegal LPG businesses need to get from your good Office so
that they will not be able to continue to commit said illegal activities or unsafe practices.

We would like to humbly invite your attention to Sec. 12 and Sec. 47 of Republic Act
No. 11592 otherwise known as LPG Industry Regulation Act, it provides that,

SEC. 12. Powers and Functions of LGUs. –  In addition to their


mandate under existing laws, LGUs shall have the following powers and
functions:

(a) Assist the DOE in identifying LPG Industry participants in violation of


the provisions of this Act;

(d) Suspend or revoke, upon due notice and hearing, the business
permit or license of an LPG industry participant upon the issuance by the
DOE of a notice of suspension or revocation of its license to operate pursuant to
Section 6 of this Act; and

SEC. 47.  Sharing of Fines and Penalties. –  The city or municipality


where the principal place of business of an LPG industry participant is
located shall be allotted a forty percent (40%) share of the proceeds from

fines and penalties collected by the DOE from the concerned LPG industry

The law allows all LGU to monetarily benefit from the apprehension of those LPG
businesses that commit illegal activities or unsafe practices because it is only with the
participation of LGU, that the total elimination of said illegal acts will be possible, and that the
utmost safety and protection of the LGU’s constituents be prioritized.
