AFFIDAVIT

I, JOSEPH SANTOS, of legal age, Filipino, married, and a resident of

Mandaluyong City, Philippines, after having been duly sworn, hereby depose and
state: That-

1. I am the business partner for the proposed restaurant business of

Maria Florabel Chang to be open and operated at Chequers Suits,
Subic Executive Loft, Manila Avenue, cor. Canal Road, Freeport Zone,
Subic Bay, Olongapo City owned by Cape York Corporation
represented by Peter Giddings and Jason Giddings as the lessor;

2. I invested for the said business because I know her personally and his
spouse David Chang and I trust on their abilities with regard to putting
up a restaurant business;

3. I took a personal loan of Two Hundred Fifty Thousand Pesos

(P250,000.00) with interest, as my capital to said restaurant
business and I personally give it to my business partner to facilitate
the expenses on the construction of improvement in the lease
property as well as to pay the balance of the security deposit so that
we will start the operation of restaurant business; Hereto attach is the
acknowledgment receipt that Maria Florabel received the said amount
as Annex A”;

4. On 6 April 2022, I went to my business partner in her shop at South

Road Brgy. Bagong Lipunan, Camp Crame, Cubao, Quezon City to give
the said amount. At around 7 p.m. the delivery truck arrived and I
help in loading the 11 pcs of metal beams to the truck to be delivered
to Peter Giddings in Subic; Hereto Attached is the actual photo while
loading the beams in the truck as Annex “B”;

5. Being her business partner, I am aware that the said metal beams
that will deliver to Peter Giddings in Subic is part of the payment for
security deposit on the leased premises and I know that the value of
the metal beams is worth Two Hundred Thousand Pesos and the
delivery fees of Twenty Thousand Pesos which paid by Maria Florabel,
6. I executed this affidavit to attest to the truth in support of her
complaint against Peter and Jason Giddings for Estafa.
