AFFIDAVIT OF COMPLAINT

I, NEAL JOY MONTERO GAURANO, of legal age, married,

Filipino and a resident of Block 57, Susana Homes, Brgy. Baliok,
Toril, Davao City, after having duly sworn to in accordance with
law, do hereby depose and say:

1. That I am the same and identical person who caused the

execution of this legal document;

2. That at around 4PM of July 12, 2022 I entered into an

agreement with one CRESMAR ELANO FERNANDEZ, of
legal age, married, a car dealer agent, and a resident of
Phase 1, Block 5, Lot 142, Eastwind Homes, San Isidro
Rodriguez, Rizal, Philippines;

3. That we have agreed that I will purchase from him one unit
FORD RANGER FX4 worth SIX HUNDRED FORTY
THOUSAND PESOS (P640,000.00) and one unit TOYOTA
WIGO worth THREE HUNDRED NINETY FIVE THOUSAND
PESOS (P395,000.00) for a total of ONE MILLION AND
THIRTY FIVE THOUSAND PESOS (P1,035,000.00);

4. That in order to proceed with the transaction, CRESMAR

ELANO FERNANDEZ asked for a downpayment of NINE
HUNDRED NINETY THOUSAND PESOS (P990,000.00) of
which I immediately deposited the said amount with RCBC
Toril Branch, Davao City, herein attached as “ANNEX 1” the
receipt of the deposit slip;

5. That after a day from the time I deposited the

downpayment, I asked CRESMAR ELANO FERNANDEZ the
status of the vehicles, whether or not the same will be given
a gate pass and be released, however, CRESMAR ELANO
FERNANDEZ made alibis, for days her made me wait
 anxiously and continued to reason out, attached herein as
“ANNEX B” our social media conversation of the
transaction;

6. That up until the present, the said vehicles that I paid for
has not been delivered to me;

7. That I am executing this affidavit freely and voluntarily to

attest to the truth of the foregoing facts and to file an
appropriate case for ESTAFA against respondent CRESMAR
ELANO FERNANDE.
