DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Absolute Sale made and executed by and between:

___________________________________, Filipinos, both of legal


age, and residents of 59 Firefly St., St. Mary’s Village,
Talon, Las Piñas City, hereinafter referred to as SELLER;

- and -

JUANITO R. ESPINOSA, Filipino, of legal age, widower,


and a resident of 23 Talisay St., Catarman, Eastern
Samar, hereinafter referred to as BUYER.

WITNESSETH That:

WHEREAS, the SELLER is the registered owner of a 298-square meter parcel of


land in St. Mary’s Village Bo. of Pamplona, Mun. of Las Piñas, Prov. of Rizal (now Talon
Uno, City of Las Piñas) together with all the improvements thereon covered by Transfer
Certificate of Title No. T-58847, Registry of Deeds for Las Piñas City and described as
follows:

“A parcel of land (Lot 15, Block 5, of the subd. plan


(LRC) Psd-120167, being a portion of a parcel of land
described on plan of Psu-101782, LRC Rec. No. N-11628),
situated in the Bo. of Pamplona, Mun. of Las Piñas, Prov. of
Rizal, Is. of Luzon. Bounded on the NE., pts. 1 to 2 by Lot
14, Blk. 5 of the subd., plan on the SE., pts. 2 to 3 by
property of Crispin Pilio, on the SW., pts. 3 to 4 by Rd. Lot 4
& on the SW., & NW., pts. 4 to 5, 5 to 1 by Rd. Lot 3, all of
the subd., plan. Xxx, containing an area of TWO HUNDRED
NINETY EIGHT (298) square meters, xxx.”

WHEREAS, the SELLER has offered for sale to the Buyer the said house and lot
and the SELLER agreed to purchase the same subject to the terms and conditions
herein set forth;

NOW, THEREFORE, the parties agreed as follows:

1. For and in consideration of FOUR MILLION PESOS (P4,000,000.00)


receipt of which in full is acknowledged, the SELLER hereby SELLS,
TRANSFERS and CONVEYS to the BUYER the above-described parcel of
land together with all the improvements thereon, free from all liens and
encumbrances;

2. The realty tax for 2005 due against the subject realty, and the capital
gains and documentary stamp taxes shall be for the account of the
SELLER whereas the documentation, transfer and registration fees shall
be borne by the BUYER.

3. That upon execution of this agreement, the VENDORS shall


deliver to the VENDEE the physical and material possession of
the said property.
4. This agreement shall be valid and binding upon the heirs,
successors, executors, administrators, and assigns of both the
contracting parties.

This Deed of Absolute Sale of a house and lot in Las Piñas City consisting of
three (3) pages including this page whereon the Acknowledgment is written was signed

A PORTION
OF A PARCEL OF LAND

KNOW ALL MEN BY THESE PRESENTS:

THAT I, ANITA R. DELA CRUZ, of legal age, Filipino, widow and


resident of Barrio ________, Almanza, Las Piñas City hereinafter called the
VENDOR, for and in consideration of the sum of ONE HUNDRED
TWELVE THOUSAND FIVE HUNDRED NINETY TWO PESOS and
SIXTY CENTAVOS (P112,592.60), Philippine Currency, receipt of which
in full is hereby acknowledged to my satisfaction from ROMULO CRUZ, of
legal age, Filipino married to Elma Mapili and resident of Area 3 A, Sityo
Libjo, Brgy. Sto. Nino, Parañaque City, hereinafter called the VENDEE, do
hereby SELLS, TRANSFERS and CONVEYS by way of Absolute Sale
unto the said VENDEE, his heirs, successors and assigns, the TWENTY
ONE (21) SQUARES METERS of the SEVEN HUNDRED (700) SQUARE
METERS of the hereinbelow described parcel of land, which in its entirety
is more particularly described hereunder as follows, to wit:

TRANSFER CERTIFICATE OF TITLE NO. 134513

“A parcel of land (Lot No. 3416-D-3 of the subd. plan (LRC) Psd-197718, being a
portion of Lot 3416-D (LRC) Psd-166455, LRC Rec. No. N-39667) situated in the Bo. of
Ibayo, Mun. of Parañaque, Prov. of Rizal, Isl. of Luzon. Bounded on the N, points 2 to 3 by
Lot 3416-D-2 of the subd. plan, on the E, points 3 to 4 by Lot 3416-E (LRC) Psd-166455,
on the S, points 4 to 1 by Lot 3416-D-4 and on the W, points 1 to 2 by Lot 3416-D-8 of the
subd. plan. Beginning at a point marked “1” on plan being s. 48’E., 40.96 m. to point 2;
thence N. 87 deg. 46’E., 17.10 m. to point 3; thence S. 1 deg. 49’W., 40.96 m. to point 4;
thence S. 87 deg. 46’W., 17.10 m. to point of beginning, containing an area of SEVEN
HUNDRED (700) SQ. METERS, more or less. All points referred to are indicated on the
plan and are marked on the ground by PS cyl. conc. mons. 15x60 cm; bearings true date of
the original survey, April 17, 1957 and that of the subd. survey, executed by Dionisio Ad.
Noblejas, Geod. Engr. on March 5, 1974.”

THAT I hereby warrant unto the said VENDEE full title and
ownership over the TWENTY ONE (21) SQUARE METERS of the above-
described parcel of land sold herein including peaceful possession thereof
free from any and all liens and encumbrances whatsoever.
