Originally the land bearing Sy.No.

54/1 of Thippaganahalli village


measuring 12 acres belongs to one A.R.Sathayanarayana Shetty S/o
Ramaiah of Y.N.Hosakote town. For his family legal necessities
A.R.Sathayanarayana Shetty S/o Ramaiah had sold 12 acres of land in
Sy.No. 54/1 of Thippaganahalli village to one Chikkanna S/o Govini
Erappa for valuable consideration of Rs. 5,000=00 by virtue of registered
sale deed dated 28-2-1970 followed by delivery of possession. Accordingly
the katha has been effected in to the name of A.R.Sathayanarayana
Shetty S/o Ramaiah. By perusing the registered sale deed dated 28-2-
1970 and encumbrance certificate dated 26-9-2022 it is very clearly goes
to shows that A.R.Sathayanarayana Shetty S/o Ramaiah is the owner in
possession and enjoyment of said 12 acres of land in Sy.No. 54/1 of
Thippaganahalli village by paying tax to Government regularly. After
durasth land bearing Sy.No. 54/1 of Thippaganahalli village has been
phoded as 54/1A2.

Original propositor Govini Erappa had two sons namely Chikkanna and
Thipperudrappa.

The said Chikkanna had wife namely Nanjamma and son Sri.
Rajashekara. Thipperudrappa had wife namely Gowramma and his two
sons namely Manjunatha and Ravi.

Later Sri. Chikkanna and his wife namely Nanjamma and son Sri.
Rajashekara had filed the suit against Thipperudrappa, Gowramma,
Manjunatha and Ravi for the relief of partition and separate possession
of their ancestral joint family properties in OS.No. 262/2005 on the file
of Civil Judge JMFC at Pavagada. On the advice of elders at their village
the said suit was ended by means of compromise. All the parties had
filed compromise petition, in the said compromise ‘A’ schedule properties
has been fallen in to the share of Chikkanna and his wife, ‘B’ schedule
properties i.e. 54/1A2 measuring 9 acres including khrab along with
other properties has been fallen to the share of C.Rajashekara and ‘C’
schedule properties has been fallen to the share of Sri. Thipperudrappa,
Smt. Gowramma and Manjunatha. Accordingly the khata has been
effected in to their respective names as per the compromise petition.
Accordingly the khata has been effected in to the name of Sri.
Rajashekara by virtue of MR.No. 7/2005-2006. Sri. Rajashekara been in
possession and enjoyment of said 8 acres of land in Sy.No. 54/1A2 of
Thippaganahalli village up to 12-10-2008.

Later on 13-10-2008 Sri. Rajashekara and his wife namely Smt.


Shanthamma had effected partition by means of panchayath palupatti
dated on 13-10-2008 with respect to land bearing Sy.No. 54/1A2
measuring 8 acres of land. In the said partition 4 acres of land has been
fallen in to the share of Sri. Rajashekara and remaining 4 acres of land
has been fallen in to the share of Smt. Shanthamma. Accordingly the
katha has been effected in to their respective name by virtue of MR.No.
29/2008-2009.

ADLR had conducted a survey, After durasth revenue authorities had


noticed that Sri. Rajashekara is in possession enjoyment of 3 acres 39
guntas of cultivable land excluding kharab of 1 gunta by virtue of MR.No.
T9/2021-20022, hence the same has been reflected in RTC extract from
the year 2019.

The said Sri. Rajashekara had caused an application before Deputy


Commissioner Tumkur for conversion of agriculture land in to Industrial
purpose for to install Bricks Industry in Sy.No. 54/1A2 of
Thippaganahalli village. The Deputy Commissioner, Tumkur had
accorded permission dated on 21-10-2022 in vide order No. 399878.
Accordingly the his name has been mutated for 1 acres 20 guntas of
converted land in Sy.no. 54/1A2 by virtue of MR.No. T14/2022-2023.

Later the said Rajashekara had executed land lease agreement in favour
of his wife Shanthamma and agreed to let out 1 acre 20 guntas to
construct office and to install/manufacture ‘Hallow blocks’ in the name
and style of RAJU HALOW BLOCKS and further the lessor and lessee
have fixed the Lease of premises at Rs. 4,50,000=00 towards lease
amount and the same had paid before the witness.

The said Smt. Shanthamma had caused application before Panchayath


authorities to install Hallow Block unit and to construct office building in
45 X 30 Sq feets. The panchayath authorites had issued license in favour
of Smt. Shanthamma had obtained the license and she got blue print for
to construct building for labour shed and for Godown, the said blue print
has been approved by panchayath authorities.

In view from any angle the documents furnished by the applicants found
genuine. The applicant No 2 had absolute and clear marketable title over
the schedule properties. The applicants had paid kandayam.

The applicants has to execute registered simple mortgage deed over


the property along with their two daughter and one son namely Nandini.
