Original propositor Govini Erappa had two sons namely Chikkanna and
Thipperudrappa.
The said Chikkanna had wife namely Nanjamma and son Sri.
Rajashekara. Thipperudrappa had wife namely Gowramma and his two
sons namely Manjunatha and Ravi.
Later Sri. Chikkanna and his wife namely Nanjamma and son Sri.
Rajashekara had filed the suit against Thipperudrappa, Gowramma,
Manjunatha and Ravi for the relief of partition and separate possession
of their ancestral joint family properties in OS.No. 262/2005 on the file
of Civil Judge JMFC at Pavagada. On the advice of elders at their village
the said suit was ended by means of compromise. All the parties had
filed compromise petition, in the said compromise ‘A’ schedule properties
has been fallen in to the share of Chikkanna and his wife, ‘B’ schedule
properties i.e. 54/1A2 measuring 9 acres including khrab along with
other properties has been fallen to the share of C.Rajashekara and ‘C’
schedule properties has been fallen to the share of Sri. Thipperudrappa,
Smt. Gowramma and Manjunatha. Accordingly the khata has been
effected in to their respective names as per the compromise petition.
Accordingly the khata has been effected in to the name of Sri.
Rajashekara by virtue of MR.No. 7/2005-2006. Sri. Rajashekara been in
possession and enjoyment of said 8 acres of land in Sy.No. 54/1A2 of
Thippaganahalli village up to 12-10-2008.
Later the said Rajashekara had executed land lease agreement in favour
of his wife Shanthamma and agreed to let out 1 acre 20 guntas to
construct office and to install/manufacture ‘Hallow blocks’ in the name
and style of RAJU HALOW BLOCKS and further the lessor and lessee
have fixed the Lease of premises at Rs. 4,50,000=00 towards lease
amount and the same had paid before the witness.
In view from any angle the documents furnished by the applicants found
genuine. The applicant No 2 had absolute and clear marketable title over
the schedule properties. The applicants had paid kandayam.
