In Kerala State Electricity Board Limited, employees are distinguished as Officers and
Workmen for administrative convenience. While the posts classified under Workmen category
function based on the provisions of Trade Unions Act 1926, those classified under Officer categéry
function relying on the provisions of the Government Servants’ Conduet Rules 1960. Accordingly,
the Board had issued order read as 1* paper above preventing employees working in posts identified
as belonging to Officer cadre from engaging themselves in trade union activities and unconditionally
ordered to relinquish membership in Trade Unions in the event of promotion to Officer cadre from
Workmen. However, it was found that certain employees, even after being promoted to Officer
cadre, are wilfully engaging themselves in the capacity of office bearers in Trade Unions
disregarding Board's Orders issued in this regard. Upon this, the Board issued the Circular read as
2 paper above strictly instructing the employees to reffain from violating Board's Orders and
warning them of disciplinary action in such instances.
While so, an employee filed WP (C) No.11027/2017 before the Hon'ble High Court
ted, in trade
challenging the involvement of certain employees working as Officers in KSEB I
union activities as office bearers and otherwise. The Hon'ble High Court after hearing the petition
directed the Chief Engineer (HRM) to dispose the case after giving the respondents an opportunity
of being heard. Based on this Court direction, the Chief Engineer (HRM) heard the respondents
and issued proceedings read as 3 paper above. The said proceedings was challenged by an
employee vide WP (C) No.18766/2017 who was a respondent in WP (C) 1027/2017 and the the
learned Single Judge after hearing the case issued orders in Board’s favour.Based on the above judgement, the Board issued Order read as 4" paper above strictly
directing all employees belonging to officer categories not to engage themselves in trade union
activities, either as ordinary member or office bearer, from the date of the order. It was also ordered
to sever all such relations with immediate effect. Direction was also issued to obtain a written
declaration in the format appended to the Board Order read 4" above from the employees on getting
promoted from Workmen to Officers, before effecting such promotion. The petitioner in WP (C)
18766/2017 preferred an appeal vide WA No.65/2018 against the order of the learned Single Judge.
The Hon’ ble Division Bench upheld the judgement of the learned Single Judge.
Throughout the Court proceedings, the main contention raised by the petitioner was that the
Board has not issued formal orders classifying the posts of employees as belonging to Workmen and
Officers. ‘The Board, as carly as in 1975, had issued orders classifying the post of Assistant
Engineer as that of Officer. The petitioner is working in a post carrying the same scale of pay as that
of Assistant Engineer. So also, the Board has classified its employees as Officers and Workmen,
even though formal orders were not issued, in various distinet revisions of pay and allowances of
Officers and Workmen during’ the last several years. “The Board, witha View to bring more clarity,
has now felt it essential to issue orders classifying the employees working in different posts of the
Board as belonging to Officer and Workmen categories in line with the Long Term Settlement and
_ Officers’ Pay Revision Order, to safeguard its interests. .
In the above.circumstance, the Board
pleased to-issue orders classifying the different posts
of employees of Kerala State Electricity Board Limited as belonging to Officer and Workmen
categories, as specified in the annexures attached to this order. Orders are issued accordingly.
